"Alternative Dispute Resolution" practices, and in particular mediation, play an increasingly important part in the way individuals; corporations and Government Departments handle their differences. For the last two years JLIB has been conducting an awareness raising initiative in Jersey on what mediation involves.
A significant development in the mediation culture in Jersey has been the introduction of Rules both in the Royal Court and the Petty Debts Court whereby the procedures of both Courts permit proceedings to be stayed to allow mediation to be tried as a means of settling a dispute. The Royal Court Rule came into effect on June 8th 2004 and a presentation was given by JLIB in the Royal Court to mark its introduction. In his speech the Bailiff, Sir Philip Bailhache, gave examples of how mediation practices can benefit parties locked in dispute. He also referred to the possible use of mediation in resolving conflicts between Government Departments and individuals and also to the potential for "Online Dispute Resolution" to develop.
