Laws Adopted By The States (a) Parish Rate (Administration) (Amendment No. 8) (Jersey) Law 1999 (P.256/98 - adopted 19.1.99) This Law, by amending the definition of "land" in Article 1 of the Parish Rate (Administration) (Jersey) Law 1946, has the effect of excluding from the payment of parish rates land covered or, in the normal course of tides, from time to time covered by sea water. (b) Finance (Jersey) Law 1999 (P.260/98 - adopted 19.1.99) This Law gives effect to various provisions contained in the 1999 Budget Report. (c) Financial Services Commission (Amendment No. 2) (Jersey) Law 1999 (P.261/98 - adopted 3.2.99) This Law removes the requirement that the Chairman of the Jersey Financial Services Commission shall be a member of the Finance and Economics Committee. (d) Loi accordant un Acte d’incorporation à l’association dite "The Beaulieu Convent School Trust" (P.6/99 - adopted 3.2.99) The purpose of this Law is to grant an Act of Incorporation to Beaulieu Convent School Trust. (e) Law Reform (Disclosure and Conduct before Action) (Jersey) Law 1999 (P.1/99 - adopted 3.2.99) The purpose of this Law is to promote the early and informed settlement of certain civil claims. (f) Adoption (Amendment No. 4) (Jersey) Law 1999 (P.5/99 - adopted 3.2.99) This Law amends the Adoption (Jersey) Laws 1961 to 1995 to - (a) establish an Adoption Panel to which the Committee may delegate its functions in relation to the maintenance of the Adoption Service; and (b) provide for allowances to be payable to persons adopting infants where adoption without payment of such an allowance would be impracticable. (g) Investment Business (Amendment) (Jersey) Law 1999 (P.8/99 - adopted 3.2.99) The purpose of this Law is to amend the Investment Business (Jersey) Law 1998 to remove the provision which prevents a person who has committed an offence under Article 13 (failure to notify change of principal person or changes in holdings) having a right of appeal under Article 11 (objection to principal person and to changes in holdings). (h) Agricultural Marketing (Amendment No. 6) (Jersey) Law 1999 (P.253/98 - adopted 16.2.99). This Law amends the Agricultural Marketing (Jersey) Law 1953 to lower certain minimum requirements that a marketing scheme under that Law must impose. (i) Housing (Amendment No. 9) (Jersey) Law 1999 (P.262/98 - adopted 16.3.99) This Law amends the Housing (Jersey) Law 1949 so as to enable the Housing Committee, on the application of the owner or lessee or intended owner or lessee of a unit of dwelling accommodation, to consent to that accommodation becoming tourist accommodation provided that - (a) the applicant is the owner or lessee of adjoining premises comprising tourist accommodation; (b) over the previous 3 years or such other period as the Committee considers appropriate there has been a net reduction in tourist accommodation and more tourist accommodation has become dwelling accommodation than vice versa (taking into account the current application); and (c) consent can be justified in the best interests of the community. (j) Age of Majority (Jersey) Law 1999 (P.23/99 - adopted 16.3.99) The purpose of this Law is to reduce the age of majority from twenty years to eighteen years. (k) Customs and Excise (Jersey) Law 1999 (P.21/99 - adopted 13.4.99) This Law consolidates, with amendments, all the Laws relating to customs and excise and impôts and the control of imports and exports. (l) Criminal Procedure (Prescription of Offences) (Jersey) Law 1999 (P.34/99 - adopted 13.4.99) This Law provides that there shall be no time limit within which a person who commits an offence may be prosecuted. 2. Regulations Made By The States (a) European Communities (Treaty of Amsterdam) (Jersey) Regulations 1999 (R & O 9361 - in force 18.2.99) The purpose of these Regulations is to include in the definition of "the Treaties" or "the Community Treaties" in Article 1 of the European Communities (Jersey) Law 1973, those parts of the Treaty signed at Amsterdam on 2nd October 1997 amending the Treaty on European Union, the Treaties establishing the European Communities and certain related Acts. (b) Health Insurance (Medical Benefit) (Amendment No. 49) (Jersey) Regulations 1999 (R & O 9362 - in force 1.1.99) These Regulations increase the amounts of medical benefit payable in respect of specified medical substances provided by approved medical practitioners to persons who are exempt from liability to pay contributions under the Health Insurance (Jersey) Law 1967. (c) Stamp Duties and Fees (Jersey) Regulations 1999 (R & O 9369 - in force 1.4.99) These Regulations replace the Schedule to the Stamp Duties and Fees (Jersey) Law 1998, which sets out the items in respect of which stamp duty is payable, and the amount of that duty. (d) Costs in Criminal Cases (Witnesses’ Allowances) (Amendment No. 4) (Jersey) Regulations 1999 (R & O 9370 - in force 17.3.99) These Regulations increase the allowances payable to persons attending at court to give evidence in criminal cases. (e) Agriculture (Loans) (Amendment No. 11) (Jersey) Regulations 1999 (R & O 9371 - in force 18.3.99) These Regulations add to the list of purposes for which money may be lent under the Agriculture (Loans) (Jersey) Regulations 1974 the purchase of seed potatoes, flower bulbs and boxes for seed potatoes when they are to be used at least in part on agricultural land for the purchase of which money is lent to the same borrower under those Regulations. 5. Other Subordinate Legislation Of Note (a) Investment Business (Registration) (Jersey) Order 1999 (R & O 9358 - in force 1.3.99) The purpose of this Order is to prescribe - (a) the classes of investment business in respect of which application may be made for registration under Article 7 of the Investment Business (Jersey) Law 1998; (b) the fees payable on such application and on registration; and (c) additional fees in cases of late payment. (b) Investment Business (Accounts, Audits and Reports) (Jersey) Order 1999 (R & O 9359 - in force 1.3.99) The purpose of this Order is to - (a) impose a duty on persons registered under the Investment Business (Jersey) Law 1998 to keep accounting records; (b) require such persons to prepare an annual financial statement, stipulate what the statement is to contain and the duties of registered persons in respect of the statement and require the statement to be submitted to the Financial Services Commission; (c) make provision concerning first balance sheets and change of accounting reference dates; (d) make provision concerning the duties of registered persons with respect to auditors and the duties of those auditors; (e) make it an offence for a registered person to make false statements to his auditors; and (f) prescribe the circumstances in which certain matters are to be communicated to the Commission. (c) Island Planning (Designation of Sites of Special Interest) (Saint John) (Jersey) Order 1999 (R & O 9384 - in force 1.4.99) The purpose of this Order is to designate a number of buildings and places in the Parish of St. John as sites of special interest by reason of the special archaeological, architectural, cultural, historical or traditional interest attaching to them. (d) Investment Business (Client Assets) (Jersey) Order 1999 (R & O 9385 - in force 1.7.99) The purpose of this Order is to regulate the holding of client money and other property by persons registered to carry on investment business under the Investment Business (Jersey) Law 1998. 6. United Kingdom Statutory Instruments Having Effect In Jersey (Registered In The Royal Court But Not Published) The Federal Republic of Yugoslavia (United Nations Sanctions) (Channel Islands) (Amendment) Order 1999 (S.I. 1999/284 - registered 12.2.99. In force 12.2.99.) This Order amends the Federal Republic of Yugoslavia (United Nations Sanctions) (Channel Islands) Order 1998 (S.I. 1998/1072), pursuant to a decision of the Security Council of the United Nations in Resolution 1160 of 31st March 1998, by prohibiting the provision of training or training facilities likely to assist in the carrying out of acts of terrorism in the Federal Republic of Yugoslavia. |
