SUMMARY OF LEGISLATION FOR THE

BAILIWICK OF JERSEY

1.      LAWS ADOPTED BY THE STATES

(a)           Prison (Amendment No. 6) (Jersey) Law 200-
(P.18/2007 - adopted in 3rd reading, 2.5.07)

This Law adds new powers to the Prison (Jersey) Law 1957 for the testing of prisoners for controlled drugs and alcohol and for authorized employees to carry out searches of prisoners.

(b)           Loi (200-) (Amendment No. 4)  sur les teneures on fidéicommis et l’incorporation d’associations
(P.50/2007 - adopted in 3rd reading, 15.5.07)

This Law expands the categories of associations that can be incorporated under the Loi (1862) sur les teneures en fidéicommis et l’incorporation d’associations.

(c)           Water Resources (Jersey) Law 200-
(P.26/2007 - adopted in 3rd reading, 5.6.07)

This Law introduces arrangements for the protection and management of Jersey’s water resources.

(d)           Criminal Justice (Miscellaneous Provisions) (No. 2) (Jersey) Law 200-
(P.56/2007 - adopted in 3rd reading, 6.6.07)

This Law repeals obsolete criminal justice legislation and corrects anomalies in such legislation.

(e)           States of Jersey (Amendment No. 3) Law 200-
(P.60/2007 - adopted in 3rd reading, 4.7.07)

This Law enables the States to make Regulations to confer similar legal immunity on advisers to that which is currently given to States members and witnesses appearing before scrutiny panels.

(f)            Distance Selling (Jersey) Law 200-
(P.66/2007 - adopted in 3rd reading, 4.7.07)

This Law sets out a number of rights and duties in relation to consumer contracts for the supply of goods or services where those contracts are entered by mail, telephone, internet or other means not involving the combined presence of consumer and supplier.

4.      REGULATIONS MADE BY THE STATES

(a)           Sea Fisheries (Les Minquiers) (Jersey) Regulations 2007

These Regulations introduce further restrictions on fishing activities at Les Minquiers with the intention of ensuring the sustainability of the lobster fishery.

(b)           Sea Fisheries (Trawling, Netting and Dredging) (Amendment No. 2) (Jersey) Regulations 2007
(R&O.62/2007 - in force 9.5.07)

These Regulations introduce further restrictions on the use of beam trawls in the Jersey part of the Granville Bay Area.

(c)           Public Employees (Contributory Retirement Scheme) (General Provisions) (Amendment No. 9) (Jersey) Regulations 2007
(R&O.63/2007 - in force 9.5.07)

These Regulations make further provision regarding the arrangements under which the Chief Minister may admit non-civil-service employees to the Public Employees Contributory Retirement Scheme.

(d)           Telecommunications (Public Pensions) (Jersey) Regulations 2007

These Regulations reduce to nil the percentage of employees of the Jersey Telecoms group who must be participants in a scheme (e.g. PECRS) under the Public Employees (Retirement) (Jersey) Law 1967.

(e)           Employment (Minimum Wage) (Amendment No. 3) (Jersey) Regulations 2007

These Regulations remove the Social Security Minister’s ability to prescribe by Order a different minimum wage for employees aged 16 and 17.

(f)            Sea Fisheries (Minimum Size Limits) (Amendment No. 4) (Jersey) Regulations 2007

These Regulations substitute the Latin names of 2 kinds of sea crabs and substitute the definition “fishing boat” in the principal Regulations.

(g)           Community Provisions (Wire Transfers) (Jersey) Regulations 2007

These Regulations introduce requirements for information to accompany wire transfers.

(h)           Unlawful Public Entertainments (Jersey) Regulations 2007

These triennial Regulations re-enact the requirement to obtain the Bailiff’s permission to provide a public entertainment.

(i)            States of Jersey (Powers, Privileges and Immunities) (Committees of Inquiry) (Jersey) Regulations 2007

These Regulations create all the necessary powers and immunities to enable a committee of inquiry appointed by the States to undertake its work.

(j)            Financial Services (Amendment of Law) (Jersey) Regulations 2007

These Regulations extend the scope of the Financial Services (Jersey) Law 1998 so that persons carrying on money service business may be regulated under it.

This Order describes developments and changes of use for which specific planning consent is not required.

(b)           Community Provisions (Belarus Sanctions) (Jersey) Order 2007

This Order freezes the assets of President Lukashenko and of other Belarus officials.

(d)           Community Provisions (Uzbekistan Sanctions) (Jersey) Order 2007

This Order prohibits the provision of assistance relating to military activities or internal repression within Uzbekistan.

(e)           Community Provisions (Burma/Myanmar Sanctions) (Jersey) Order 2007
(R&O.73/2007 - in force 25.5.07)

This Order prohibits the provision of assistance relating to military activities or internal repression within Burma/Myanmar and freezes the assets of members of the Government of Burma/Myanmar and persons associated with them.

(f)            Community Provisions (Implementation of the Mandate of the International Criminal Tribunal for the former Yugoslavia) (Jersey) Order 2007

This Order freezes the assets of person indicted by the International Criminal Tribunal for the former Yugoslavia.

(g)           Building Bye-Laws (Jersey) 2007

These Bye-Laws impose requirements relating to building work.
