Laws Adopted By The State (a) Magistrate’s Court (Miscellaneous Provisions) (Amendment No. 6) (Jersey) Law 1997 (P.62/97 - adopted 13.5.97) This Law amends the Magistrate’s Court (Miscellaneous Provisions) (Jersey) Law 1949 - (i) to empower the Royal Court, on hearing an appeal from the Magistrate’s Court to award the successful appellant the costs of the proceedings in the Magistrate’s Court; (ii) to make it clear that the Royal Court has power to order an unsuccessful appellant to pay the costs of the prosecution. (b) Costs in Criminal Cases (Amendment) (Jersey) Law 1997 (P.63/97 - adopted 13.5.97) This Law amends the Costs in Criminal Cases (Jersey) Law 1961 - (i) to enlarge the power of the Court of Appeal to enable it to order the payment of costs out of public funds when it allows an appeal against sentence; (ii) to confer a similar power on the Superior Number of the Royal Court when allowing an appeal against sentence from the Inferior Number; (iii) to take account of the introduction of committals for sentence under Article 4A of the Magistrate’s Court (Miscellaneous Provisions) (Jersey) Law 1949. (c) NatWest Offshore Limited (Jersey) Law 1997 (P.67/97 - adopted 20.5.97) The purpose of this Law is to enable NatWest Group to bring together its different operations in the Island into a single company. (d) States of Jersey (Amendment No. 6) (Jersey) Law 1997 (P.74/97 - adopted 3.6.97) This Law provides that - (i) an amendment to an enactment, necessitated by a transfer of the functions of a Committee, an amalgamation of a Committee or a change of a Committee name pursuant to Article 29 of the States of Jersey Law 1966 ("the principal Law") may be made not only to a Jersey Law but also to an enactment of the United Kingdom as extended to Jersey; and (ii) a Committee’s power to delegate functions pursuant to Article 36A of the principal Law extends not only to functions conferred upon or vested in it pursuant to a Jersey Law but also to functions conferred upon or vested in it pursuant to an enactment of the United Kingdom as extended to Jersey. (e) The Lloyds TSB (Jersey) Law 1997 (P.77/97 - adopted 17.6.97) This Law provides for the inter group transfer and vesting of the undertakings of subsidiaries in the Island of Lloyds TSB Group plc. (f) Loi (1997) pour abroger la Loi (1902) au sujet des ordres religieux étrangers (P.79/97 - adopted 17.6.97) This Loi repeals the Loi (1902) au sujet des ordres religieux étrangers which prohibits foreign nationals establishing in the Island a religious order comprising more than six people. (g) Privileges and Immunities (Diplomatic, Consular, etc.) (Jersey) Law 1997 (P.94/97 - adopted 22.7.97) The purpose of this Law is to give effect in the Island to the Vienna Conventions on Diplomatic and Consular Relations, to make provision for privileges and immunities in connection with Commonwealth and Irish establishments and to make provision for certain privileges, immunities and facilities to be accorded to certain international organisations and their representatives. (h) Hong Kong Economic and Trade Office (Privileges and Immunities) (Jersey) Law 1997 (P.95/97 - adopted 22.7.97) This Law makes provision for conferring privileges and immunities in relation to an economic and trade office established by the government of the Hong Kong Special Administrative Region in the United Kingdom or in the Island. 2. Regulations Made By The States (a) Policing of Parks (Amendment No. 12) (Jersey) Regulations 1997 (R & O 9088 - in force 11.7.97) These Regulations amend further the Policing of Parks (Jersey) Regulations 1962 ("the Regulations") so as to - (i) make the Sports, Leisure and Recreation Committee the park authority for Glacis Field, Fort Regent, in place of the Fort Regent Development Committee; (ii) remove the exemption from prohibition on riding a pedal cycle in a park for children going to or from school along Corbière Walk; and (iii) apply the Regulations to Springfield Sports Ground, for which the park authority will be the Sports, Leisure and Recreation Committee. (b) Merchant Shipping (Deck Officers) (Jersey) Regulations 1997 (R & O 9093 - in force for three years with effect from 1.8.97) The purpose of these Regulations is to prescribe requirements for Jersey registered ships and for passenger ships to carry a specified number of qualified deck officers determined according to the tonnage of the ship and the voyage to, from or between locations in specified trading areas on which it will be engaged. (c) Merchant Shipping (Marine Engineer Officers and Marine Engineer Operators) (Jersey) Regulations 1997 (R & O 9094 - in force for three years with effect from 1.8.97) These Regulations prescribe requirements for Jersey registered ships having registered power of 350 kilowatts or more, including sail training ships with a propulsion engine, to carry a specified number of engineer officers and marine engine operators determined according to the registered power of the ship and the voyage to, from or between locations in specified trading areas on which it will be engaged. 5. Other Subordinate Legislation Of Note (a) Disability Transport Allowance (General Provisions) (Jersey) Order 1997 (R & O 9080 - in force 1.5.97) This Order prescribes the circumstances in which disability transport allowance may be claimed and the mechanism for claiming the allowance. (b) Food Hygiene (General Provisions) (Amendment No. 4) (Jersey) Order 1997 (R & O 9083 - in force 1.6.97) This Order increases penalties under the Food Hygiene (General Provisions) (Jersey) Order 1967 ("the principal Order"), by making a person guilty of an offence under the principal Order liable to an unlimited fine, or to imprisonment for two years, or both. (c) Import and Export (Control) (Amendment No. 5) (Jersey) Order 1997 (R & O 9084 - in force 19.5.97) The purpose of this Order is to prohibit the exportation to any other of the British Islands of certain items of cultural or artistic value to the Island. {(d) Motor Vehicles (Driving Licences) (Amendment No. 6) (Jersey) Order 1997 { (R & O 9095 - in force 1.8.97) { {(e) Motor Vehicles (Driving Licences) (Amendment No. 7) (Jersey) Order 1997 (R & O 9100 - in force 1.9.97) These Orders amend the Motor Vehicles (Driving Licences) (Jersey) Order 1993 by - (i) revising the requirements for eligibility to apply for licences in categories B+E, C and D; (ii) reviewing the additional categories in which holders of licences in categories B, B1, C, C1, D, D1, B+E, C+E, C1+E, D+E and D1+E are eligible to drive vehicles; (iii) revising the definitions of categories B1, C, C1+E and D1+E; (iv) abolishing the existing category L for vehicles that are propelled electrically; (v) introducing additional requirements for vehicles that must be provided for driving tests in categories A1, A, B+E, C1, C1+E and D1; (R & O 9095) and (vi) introducing basic training courses for motor bicycles, for persons who wish to take the driving test for a moped or a light motor cycle (R & O 9100). (f) Summer Time (Jersey) Act 1997 (R & O 9101 - in force 30.7.97) The purpose of this Act is to fix the periods of summer time in Jersey for the years 1998, 1999, 2000 and 2001. |
