SUMMARY OF LEGISLATION

1.      LAWS ADOPTED BY THE STATES

(a)           Public Finances (Jersey) Law 200-
(P.180/2004 - adopted 19.1.05)

This Law replaces the Public Finances (Administration) (Jersey) Law 1967.

(b)           Finance (Jersey) Law 200-
(P.229/2004 - adopted 19.1.05)

This Law sets the rate of income tax for 2005 and amends the Customs and Excise (Jersey) Law 1999 and the Stamp Duties and (Fees) (Jersey) Law 1998.

(c)           Income Tax (Amendment No. 24) (Jersey)  Law 200-
(P.230/2004 - adopted 19.1.05)

This Law amends the Income Tax (Jersey) Law 1961 to introduce the income tax instalment system, to alter the rules for trades chargeable under Schedule D, for child allowance and for apportionment of allowances when a person is absent from Jersey, and to introduce rules for the taxation of certain residents.

(d)           Medicines (Amendment No. 2) (Jersey)  Law 200-
(P.214/2004 - adopted 1.2.05)

This Law amends the Medicines (Jersey) Law 1995 as to the classification of medicines that may be supplied on prescription only, or by sale by a pharmacist or by general sale.

(e)           Royal Court (Amendment No. 11) (Jersey) Law 200-
(P.7/2005 - adopted 2.3.05)

This Law amends the Royal Court (Jersey) Law 1948, empowering the Bailiff to appoint Commissioners to discharge any of the judicial functions exercisable by the Bailiff.

(f)            Termination of Pregnancy (Amendment) (Jersey) Law 200-
(P.15/2005 - adopted 2.3.05)

This Law amends the Termination of Pregnancy (Jersey) Law 1997 as to the grounds on which a termination may be carried out by reason of foetal abnormality, and to make other, administrative changes.

(g)           Regulation of Investigatory Powers (Jersey) Law 200-
(P.196/2004 - adopted 15.3.05)

This Law replaces the Interception of Communications (Jersey) Law 1985 and makes new provision to regulate the interception of communications, the obtaining of communications data and the conduct of surveillance.

(h)           Jersey Overseas Aid Commission (Jersey) Law 200-
(P.14/2005 - adopted 16.3.05)

This Law establishes a Jersey Overseas Aid Commission.

(i)            Bankruptcy (Netting) Contractual Subordination and Non-Petition Provisions (Jersey) Law 200-
(P.30/2005 - adopted 5.4.05)

This Law will ensure that that netting, contractual subordination and non-petition provisions of agreements are enforceable in accordance with their terms and continue to be enforceable despite bankruptcy.

(j)            Fertilisers and Feeding Stuffs (Amendment) (Jersey) Law 200-
(P.28/2005 - adopted 5.4.05)

This Law amends the Fertilisers and Feeding Stuffs (Jersey) Law 1950 so as to make provision to regulate the import, export, sale, possession and use of ingredients of fertilisers and animal feeding stuffs.

(k)           Diseases of Animals (Amendment No. 6) (Jersey) Law 200-
(P.29/2005 - adopted 5.4.05)

This Law amends the Diseases of Animals (Jersey) Law 1956 so as to increase the powers of inspectors and to create new offences.

(l)            Loi (Amendement No. 5) sur la Propriété Foncière
(P.42/2005 - adopted 5.4.05)

This Law amends the Loi (1880) sur la propriété foncière so that judgments of the Petty Debts Court will be capable of being registered in the Public Registry so as to create a judicial hypothec.

(m)          Data Protection (Amendment) (Jersey) Law 200-
(P.50/2005 - adopted 5.4.05)

This Law amends the Data Protection (Jersey) Law 2005 so as to widen the power to make Regulations exempting personal information from disclosure.

These Regulations replace the Honorary Police (Jersey) Regulations 1977.

(b)           Housing (General Provisions) (Amendment No. 21) (Jersey) Regulations 2005

These Regulations enable the grant of consent to a 1(1)(k) resident for a short-term lease of residential accommodation.

(c)           Règlement (2005)(Abrogation) sur les Portefaix
(R&O.15/2005 - in force 9.3.05)

These Regulations repeal the Règlement (1959) sur les Portefaix

(d)           Employment Tribunal (Jersey) Regulations 2005
(R&O.20/2005 - in force on the same day as the Employment (Jersey) Law 2003)

These Regulations provide for the composition of the Jersey Employment Tribunal, the terms of appointment of its members, their remuneration and the Tribunal’s sittings.

(e)           Community Provisions (Animal Feeding) (Jersey) Regulations 2005

These Regulations update give full force and effect in Jersey to that part of an EC Regulation that prohibits the feeding of certain animal proteins to specified animals.

(f)            Sea Fisheries (Minimum Size Limits) (Amendment No. 2) (Jersey) Regulations 2005

These Regulations widen the definition of sole for the purposes of the minimum size of fish that may be retained.

This Order replaces the Community Provisions (Burma/Myanmar Sanctions) (Jersey) Order 2004.

(b)           Shipping (Safety Codes) (Jersey) Order 2005

This Order requires Jersey ships to comply with the Jersey Code of Practice on the Safety Standards Applicable to Small Commercial Ships.

(c)           Shipping (Survey and Certification) (Jersey) Order 2005
(R&O.18/2005 - in force 1.4.05)

This Order provides for the Merchant Shipping (Survey and Certification) Regulations 1995 of the United Kingdom to apply to Jersey, with modifications.
