Laws Adopted By The States (a) Education (Jersey) Law 1999 (P.30/99 - adopted 11.5.99) This Law replaces existing Laws and makes new provision in relation to education. (b) Parish Rate (Administration) (Amendment No. 9) (Jersey) Law 1999 (P.51/99 - adopted 11.5.99) This Law amends the Parish Rate (Administration) (Jersey) Law 1946 so as to revise the constitution of the Parish Rate Appeal Board and its procedures when hearing an appeal. (c) Protection of Children (Amendment No. 2) (Jersey) Law 1999 (P.50/99 - adopted 25.5.99) This Law amends the Protection of Children (Jersey) Law 1994 to - (a) extend the obligation of the Magistrate’s Court to order the forfeiture of indecent photographs or pseudo-photographs of children on the conviction of a person of an offence in respect of such photographs to all courts who convict persons of such offences; and (b) provide that where a person is charged with such an offence but is acquitted by virtue of being able to prove one of the defences provided by that Law, the court which acquitted the person may nevertheless order the forfeiture of any indecent photographs or pseudo-photographs that formed the basis of the charge. (d) Affiliation Proceedings (Prescription) (Jersey) Law 1999 (P.52/99 - adopted 25.5.99) This Law provides that an action for the maintenance of an illegitimate child (pension alimentaire) may be begun at any time after the birth of the child and accordingly abolishes the prescriptive period of one year and a day for that action. (e) Statutory Nuisances (Jersey) Law 1999 (P.40/98 - adopted 22.6.99) This Law provides for statutory nuisances and establishes procedures for dealing with them. (f) Criminal Hoaxes (Jersey) Law 1999 (P.75/99 - adopted 29.6.99) This Law makes it an offence, punishable by a fine of imprisonment for a term not exceeding seven years or both - (a) to place any thing in a place, or despatch to another place any thing, with the intention of inducing a person to believe that it will explode or ignite, or be released or exposed, causing injury or damage; or (b) to communicate false information to a person to induce him to believe there is any thing in any place that is liable to explode or ignite, or if released or exposed, to cause personal injury or damage to property. (g) Arbitration (Amendment) (Jersey) Law 1999 (P.78/99 - adopted 7.7.99) The purpose of this Law is to amend the Arbitration (Jersey) Law 1998 so as to remove differences in treatment between domestic and non-domestic arbitration agreements. The Law will then comply with European Union legislation on this matter. (h) Conservation of Wildlife (Jersey) Law 1999 (P.87/99 - adopted 20.7.99) The purpose of this Law is to consolidate and amend the law relating to wildlife. It replaces the Wildlife Protection (Jersey) Law 1947 and most of the Protection of Birds (Jersey) Law 1963. (i) Fees (Miscellaneous Amendments and Validation) (Jersey) Law 1999 (P.88/99 - adopted 26.7.99) The purpose of this Law is to - (a) amend various Laws administered by the Jersey Financial Services Commission on behalf of the Finance and Economics Committee to empower the Committee to make Orders prescribing fees which raise income in excess of that required by the Committee and the Commission to discharge their respective functions under those Laws; and (b) validate the imposition and recovery of any such fees pursuant to Orders made before the coming into force of this Law. (j) Post Office (Amendment No. 2) (Jersey) Law 1999 (P.89/99 - adopted 26.7.99) The purpose of this Law is to - (a) amend the Post Office (Jersey) Law 1969 to empower the Committee for Postal Administration to make Orders prescribing postal charges which raise income in excess of that required by the Committee to discharge its functions under that Law; and (b) validate the imposition and recovery of any such charges pursuant to Orders made before the coming into force of the Law. (k) Telecommunications (Amendment No. 3) (Jersey) Law 1999 (P.90/99 - adopted 26.7.99) The purpose of this Law is to - (a) amend the Telecommunications (Jersey) Law 1972 to empower the Telecommunications Board to make Orders prescribing charges for telecommunications services which raise income in excess of that required by the Board to discharge its functions under that Law; and (b) validate the imposition and recovery of any such charges pursuant to Orders made before the coming into force of the Law. 2. Regulations Made By The States (a) Community Provisions (Prohibiting the Sale and Supply of Petroleum and Certain Petroleum Products to the Federal Republic of Yugoslavia) (Jersey) Regulations 1999 (R & O 9396 - in force 27.5.99) These Regulations give effect in the Island to Council Regulation (EC) 900/99 which prohibits the sale and supply to the Federal Republic of Yugoslavia of petroleum and certain petroleum products. (b) Community Provisions (Prohibition on Flights of Yugoslav Carriers) (Jersey) Regulations 1999 (R & O 9397 - in force 27.5.99) These Regulations give effect in the Island to Council Regulation (EC) 1901/98 which prohibits flights of Yugoslav carriers between the Federal Republic of Yugoslavia and the European Community. (c) Regulation of Undertakings and Development (Amendment No. 10) (Jersey) Regulations 1999 (R & O 9413 - in force 1.7.99) The main purpose of these Regulations is to amend the Regulation of Undertakings and Development (Jersey) Regulations 1978 by replacing the exemption relating to increases in the number of persons engaged in an undertaking so as to provide for the employment of additional categories of locally qualified people. (d) Boats and Surf-Riding (Control) (Amendment No. 18) (Jersey) Regulations 1999 (R & O 9417 - in force 11.7.99) These Regulations extend the areas where it is unlawful to operate a jet-ski or similar craft at over 5 knots. (e) Licensing (No. 13) (Jersey) Regulations 1999 (R & O 9418 - in force 11.7.99) These Regulations allow the holders of Taverners, Residential, Restaurant, Comprehensive, Club and Entertainment Licences to keep their premises open throughout the night of 31st December 1999. (f) Health Insurance (Medical Benefit) (Amendment No. 50) (Jersey) Regulations 1999 (R & O 9425 - in force 1.10.99) These Regulations increase the standard rate in respect of medical services provided by an approved medical practitioner from £10 to £10.50. (g) Sea Fisheries (Trawling, Netting and Dredging) (Jersey) Regulations 1999 (R & O 9426 - in force 2.8.99) These Regulations control certain fishing activities within the extended territorial sea of the Island. (h) Sea Fisheries (Inshore Trawling, Netting and Dredging) (Jersey) Regulations 1999 (R & O 9427 - in force 2.8.99) These Regulations control certain fishing activities within the exclusive three mile limit of the territorial sea of the Island. 5. Other Subordinate Legislation Of Note (a) Money Laundering (Jersey) Order 1999 (R & O 9399 - in force 1.7.99) This Order prescribes procedures to be maintained by persons who carry on financial service business for the purposes of forestalling and preventing money laundering. (b) Radio Equipment (Jersey) Order 1999 (R & O 9409 - in force 1.7.99) This Order restricts the import, manufacture, sale, hire, offer or advertisement for sale or hire, custody and control of certain specified Citizen Band radio apparatus and amateur radio apparatus, and cordless telephone apparatus. |
