IN THE EMPLOYMENT AND DISCRIMINATION TRIBUNAL

IN THE MATTER:

BETWEEN

Miss Liliana Correia

CLAIMANT

AND

Mr Ivo de Castro & Mrs Lynsey de Castro t/a DC Cleaners

RESPONDENT

LEAVE TO APPEAL DECISION

Reference: [2018]TRE031

DECISION

The Appellant's application for an extension of time pursuant to Article 94(3) of the Employment (Jersey) Law 2003 (the "Law") is granted.

The Appellant's application for permission to appeal against the decision of the Tribunal dated 19th April 2018 (the "Decision") is refused.

The Appellant's application for permission to appeal against the decision of the Tribunal dated 25th May 2018 (the "Judgment") is refused.

COMMENT / REASONS:

I have reviewed and compared the application for leave to appeal in the related case, 32/18. The issues and the grounds of appeal in both cases are virtually identical, which I note is something highlighted by Advocate McDonald, for the Claimant.

In my judgment the present application for leave to appeal, is not materially different to the application for leave to appeal in case 32/18. Leave to appeal in that case was refused.

For the same reasons as those already given in relation to case 32/18, leave to appeal in this case is also refused.
