JUDGMENT

 

The Respondent shall pay to the Claimant the sum of £1,042.76 as damages for breach of contract.

 

 

THE REASONS

 

1.       By a claim form presented on 8 May 2018, the Claimant brought the following complaints:

a.       unfair dismissal; and

b.      unpaid wages;

(the “Claims”).

 

2.       The Respondent defended the Claims and issued a counterclaim for eight days’ alleged overpayment of holiday pay (“Counterclaim”).

 

3.       At a Case Management Meeting, the Respondent accepted that it owed the Claimant £1,042.76 for unpaid wages.

 

4.       Following some private discussions between the parties, the Claimant withdrew his claim for unfair dismissal and the Respondent withdrew the Counterclaim (this being confirmed by Mrs Bielanska-Stone by email).

 

Conclusion

 

5.       The Respondent shall pay to the Claimant £1,042.76 by way of damages for breach of contract for failing to pay wages to the Claimant
