ARTICLE 12 JUDGMENT

Reference: TRE[2018]153

Before:             Mrs. H G Griffin, Chairman

JUDGMENT

(1)            As a result of no Response Form having been presented on the expiry of the time limit in Article 8 of the Employment and Discrimination Tribunal (Procedure) Order 2016 (“Procedure Order”), the Claimant’s claims are successful.

(2)            The Respondent shall pay to the Claimant the sum of £310.50.

THE REASONS

The Claim

1.              The Claimant presented her Claim Form on 9 October 2018 for unpaid wages.

No Response

2.              No response having been received, I decided that a determination on this matter can be properly made.  Article 12 of the Procedure Order states I must therefore issue a judgment accordingly.

The Calculations

3.              The Claimant was employed from Saturday 4 August 2018 to Friday 10 August 2018.  During that period she worked 34.5 hours at a rate of £9 per hour.  The Claimant did not receive payment for the hours worked.

34.5 x 9 = £310.50

4.              The Respondent shall pay to the Claimant the sum of £310.50 by way of damages for unpaid wages.

Summary of Award

Damages for Breach of contract (unpaid wages)

£310.50

TOTAL AWARD

£310.50
