POISONS (GENERAL PROVISIONS) (AMENDMENT No. 6) (JERSEY) ORDER 1994

THE PUBLIC HEALTH COMMITTEE, in pursuance of Article 25 of the Pharmacy, Poisons and Medicines (Jersey) Law 1952, as amended,1 hereby orders as follows –

1.             After paragraph (6B) of Article 17 of the Poisons (General Provisions) (Jersey) Order 1968,2 as amended (hereinafter referred to as “the principal Order”), there shall be inserted the following paragraph –

“(6C)     It shall not be lawful to sell or supply aluminium phosphide:

Provided that this paragraph shall not apply to the sale of aluminium phosphide –

(a)     by way of wholesale dealing; or

(b)     to be exported to purchasers outside the Island by a person who is authorized in writing by the Committee so to do; or

(c)     to a person or institution concerned with scientific education or research or chemical analysis for purposes of that education or research or analysis; or

(d)     to a person producing a written authority in the form set out in the Nineteenth Schedule to this Order issued by a person duly authorized by the Committee, authorizing the purchase of aluminium phosphide for the purpose of killing moles.”.

2.             In paragraph (1) of Article 37 of the principal Order for the word “Nineteenth” there shall be substituted the word “Twentieth”.

3.             In Part B of the Fourth Schedule to the principal Order–

(a)     there shall be inserted at the appropriate places in alphabetical order the items set out in the First Schedule to this Order;

(b)     for the item relating to “Clotrimazole” there shall be substituted the following item –

“Clotrimazole (except for external use and in the case of vaginal use only for the treatment of vaginal candidiasis)”;

(c)     for the item relating to “Ibuprofen” there shall be substituted the following item –

“Ibuprofen (except in a preparation for topical use)”;

(d)     for the item relating to “Sodium Cromoglycate” there shall be substituted the following item –

“Sodium Cromoglycate (except in a preparation manufactured, sold or supplied for the treatment of acute seasonal allergic rhinitis in the form of an eye ointment or in the form of aqueous eye drops or in a preparation manufactured, sold or supplied for use by being administered through the nose)”;

(e)     for the item relating to Ketoprofen there shall be substituted the following item –

“Ketoprofen (except in a preparation for topical use with a maximum strength of 2.5 per cent when sold or supplied in a container or package containing not more than 30 grammes)”.

4.             After the Eighteenth Schedule to the principal Order there shall be inserted the Schedule set out in the Second Schedule to this Order.

5.             The Nineteenth Schedule to the principal Order shall be renumbered the Twentieth Schedule.

6.             This Order may be cited as the Poisons (General Provisions) (Amendment No. 6) (Jersey) Order 1994 and shall come into force forthwith.
