Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 3) (Jersey) Order 2021

THE MINISTER FOR HEALTH AND SOCIAL SERVICES makes this Order under Regulations 2 and 3 of the Covid-19 (Workplace Restrictions) (Jersey) Regulations 2020[1] and after complying with the consultation requirements set out in Regulation 2(1) and (2) of those Regulations and under Regulation 2 of the Covid-19 (Gatherings) (Jersey) Regulations 2020[2], after complying with the consultation requirements in Regulation 2(3) of those Regulations –

1        Covid-19 (Workplace Restrictions) (Jersey) Order 2020 amended

Articles 2 to 8 amend the Covid-19 (Workplace Restrictions) (Jersey) Order 2020[3].

2        Article A1 (interpretation) amended

In Article A1(1) –

(a)     after the definition “accommodation premises” there is inserted –

“ “amusement centre” means a building or place used principally for playing billiards or other like games, electronic or mechanical amusement devices such as pinball machines, video or arcade games and the like;”;

(b)     after the definition “indoor physical activity facility” there is inserted –

“ “indoor play area” includes any part of a workplace used for soft play, play that involves the use of play equipment such as climbing frames, swings, ropes, slides or a ball pit or dressing up;”.

3        Article 2 (closure of certain workplaces) amended

In Article 2 the following are deleted –

(a)     paragraph (1)(a), (ea) and (h);

(b)     in paragraph (2) the definitions “amusement centre” and “indoor play area”.

4        Article 3 (specified workplaces open to the public for certain purposes) amended

In Article 3 –

(a)     in the heading after “purposes” there is inserted “or subject to specified conditions”;

(b)     in paragraph (1) after “purposes” there is inserted “or conditions”;

(c)     paragraph (1)(e) is deleted;

(d)     in paragraph (1)(f) for “for a purpose specified in paragraph (2A)” there is substituted “on condition that the operator or occupier of the workplace or, in the case of an organised event at the workplace, the organiser, has taken all reasonable steps to assist in controlling the spread of Covid‑19, including taking account of any guidance published by the Medical Officer of Health as to factors that increase the risk of spread of Covid‑19 in gatherings”;

(e)     paragraph (2A) and the definition “registered person” in Article 3(6) are deleted.

5        Article 5 (visitors required to wear masks) amended

In Article 5(3) –

(a)     after “Order” there is inserted “to the extent specified”;

(b)     in sub-paragraph (i), for “, for the purposes mentioned in Article 3(2A)(a) and (c)” there is substituted “except while in a part of the facility currently being used for sport, dance or exercise”;

(c)     after sub-paragraph (i) there is inserted –

“(ia)   changing facilities, except while actually changing;

(ib)     indoor play areas;”;

(d)     after sub-paragraph (m) there is inserted –

“(n)    amusement centres.”.

6        Article 5A (condition of opening: workers wearing masks or visors) amended

In Article 5A(2) –

(a)     after “the following” there is inserted “to the extent specified”;

(b)     in paragraph (2)(g) for “, for the purposes mentioned in Article 3(2A)(a) and (c)” there is substituted “except while in a part of the facility currently being used for sport, dance or exercise”;

(c)     after sub-paragraph (g) there is inserted –

“(ga)  changing facilities;

(gb)    indoor play areas;”;

(d)     after sub-paragraph (i) there is inserted –

“(j)     amusement centres.”.

7        Article 5B (conditions of opening: visitors giving contact tracing data) amended

After Article 5B(2)(c) there is inserted –

“(d)    indoor physical activity facilities, except where the visitor is a child who is part of a gathering mentioned in Article 8(1)(a) to (c) of the Covid‑19 (Gathering Control) (Jersey) Order 2020[4] (exception: certain gatherings involving young people);

(e)     indoor play areas;

(f)      amusement centres.”.

8        Article 5C (condition of opening: distancing in workplaces) amended

(1)     In Article 5C(2) –

(a)     in sub-paragraph (f), “, for the purpose mentioned in Article 3(2A)(a)” is deleted;

(b)     after sub-paragraph (f) there is inserted –

“(fa)   subject to paragraph (4), changing or shower facilities;”;

(c)     after sub-paragraph (i) there is inserted –

“(j)     amusement centres.”.

(2)     For Article 5C(4) there is substituted –

“(4)    The requirement in paragraph (1) does not apply –

9        Covid-19 (Gathering Control) (Jersey) Order 2020 amended

In the Covid‑19 (Gathering Control) (Jersey) Order 2020[5] –

(a)     in Article 5 (gatherings in certain workplaces), after paragraph (2)(i) there is inserted –

“(j)     indoor physical activity facilities (within the meaning given by the Covid-19 (Workplace Restrictions) (Jersey) Order 2020[6]);

(k)     swimming pools and paddling pools;

(l)      changing and shower facilities;

(m)    amusement centres (within the meaning given by the Covid‑19 (Workplace Restrictions) (Jersey) Order 2020[7]);”

(b)     in Article 8 (exception: certain gatherings involving young people), in paragraph (1) –

(i)      sub-paragraph (c)(i) is deleted,

(ii)      in sub-paragraph (d) for “35” there is substituted “45”;

(c)     in Article 8A (exception: certain gatherings involving adults), for “35” there is substituted “45”.

10      Citation and commencement

This Order may be cited as the Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 3) (Jersey) Order 2021 and comes into force on 15th March 2021.
