Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 4) (Jersey) Order 2021

THE MINISTER FOR HEALTH AND SOCIAL SERVICES makes this Order under Regulations 2 and 3 of the Covid-19 (Workplace Restrictions) (Jersey) Regulations 2020[1] and after complying with the consultation requirements set out in Regulation 2(1) and (2) of those Regulations and under Regulation 2 of the Covid-19 (Gatherings) (Jersey) Regulations 2020[2], after complying with the consultation requirements in Regulation 2(3) of those Regulations –

1        Covid-19 (Workplace Restrictions) (Jersey) Order 2020 amended

Articles 2 to 8 amend the Covid-19 (Workplace Restrictions) (Jersey) Order 2020[3].

2        Article A1 (interpretation) amended

In Article A1(1) –

(a)     in the definition “indoor physical activity facility” for “place”, in both places where it occurs, there is substituted “area”;

(b)     after the definition “retail premises” there is inserted –

“ “ritual gathering” means a gathering –

(a)     for the celebration of a marriage or civil partnership;

(b)     for a funeral; or

(c)     that is part of a service of religious worship,

but not a reception, wake or other event separate from but commonly associated with the gathering;”.

3        Article 3 (specified workplaces open to the public for certain purposes or subject to specified conditions) amended

In Article 3(1) –

(a)     after sub-paragraph (b) there is inserted –

“(c)    a workplace in an outdoor area being used by adults for sport or exercise, on condition that –

(i)      the total number of people participating in, watching, supporting or facilitating the sport or exercise must not exceed 45, and

(ii)      the occupier or operator of the workplace has taken all reasonable steps to assist in controlling the spread of Covid‑19, including taking account of any guidance published by the Medical Officer of Health as to factors that increase the risk of spread of Covid‑19 in gatherings;”;

(b)     in sub-paragraph (g) after “visitor attractions” there is inserted “(including outdoor areas)”.

4        Article 5 (visitors required to wear masks) amended

After Article 5(3)(n) there is inserted –

“(o)    a workplace in an indoor area used for a ritual gathering if more than 45 people are participating in the gathering.”.

5        Article 5A (condition of opening: workers wearing masks or visors) amended

After Article 5A(2)(j) there is inserted –

“(k)    a workplace in an indoor area used for a ritual gathering if more than 45 people are participating in the gathering.”.

6        Article 5B (conditions of opening: visitors giving contact tracing data) amended

After Article 5B(2)(f) there is inserted –

“(g)    a workplace in an indoor area used for a ritual gathering if more than 45 people are participating in the gathering.”.

7        Article 5C (condition of opening: distancing in workplaces) amended

After Article 5C(2)(j) there is inserted –

“(k)    a workplace in an indoor area used for a ritual gathering if more than 45 people are participating in the gathering.”.

8        Article 5D (condition of opening: children’s activity group) substituted

For Article 5D there is substituted –

5D   Exception for certain gatherings of children in workplaces

(1)     No requirement of Article 5, 5B or 5C applies in respect of the following gatherings in a workplace –

(a)     a gathering to which Article 8(1)(a), (b) or (d) of the Gatherings Order applies; or

(b)     a gathering to which Article 8(1)(c) of the Gatherings Order applies, unless 10 or more people are participating in the gathering.

(2)     In this Article –

(a)     “Gatherings Order” means the Covid‑19 (Gathering Control) (Jersey) Order 2020[4];

(b)     a reference to people participating in a gathering does not include activity organisers (as defined in Article 8(2) of that Order) or children under 5 years of age.”.

9        Covid-19 (Gathering Control) (Jersey) Order 2020 amended

(1)     This Article amends the Covid‑19 (Gathering Control) (Jersey) Order 2020[5].

(2)     In Article 5(2) –

(a)     in sub-paragraph (f) and (m) “(within the meaning of the Covid‑19 (Workplace Restrictions) (Jersey) Order 2020[6])” is deleted;

(b)     for sub-paragraph (j) there is substituted –

“(j)     indoor physical activity facilities or a workplace in an outdoor area used for sport or exercise;”;

(c)     after sub-paragraph (m) there is inserted –

“(n)    a workplace used for a ritual gathering.”.

(3)     After Article 5(3) there is inserted –

“(4)    In this Article words and phrases used in the Covid‑19 (Workplace Restrictions) (Jersey) Order 2020[7] have the same respective meanings as in that Order.”.

(4)     Articles 7 (exception: gatherings of 40 allowed for certain purposes) and 8A (exception: certain gatherings involving adults) are deleted.

(5)     In Article 8 –

(a)     paragraph (1)(c)(iv) is deleted;

(b)     for paragraph (1)(d) there is substituted –

“(d)    a controlled gathering of children in the open air if the total number of people gathered, excluding children under 5 years of age, does not exceed 45.”;

(c)     in paragraph (2) –

(i)      in the definition “activity organiser” “, as defined in Article 7,” is deleted,

(ii)      for the definition “controlled gathering” there is substituted –

“ “controlled gathering” means a gathering at which a responsible person has taken all reasonable steps to assist in controlling the spread of Covid‑19;”,

(iii)     after the definition “registered day care” there is inserted –

“ “responsible person” means –

(a)     a person responsible for organising the gathering; or

(b)     an operator or occupier (within the meaning of Regulation 1(1) of the Covid-19 (Workplace Restrictions) (Jersey) Regulations 2020[8]) of the location where the gathering takes place;”.

10      Citation and commencement

This Order may be cited as the Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 4) (Jersey) Order 2021 and comes into force on 26th March 2021.
