Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 5) (Jersey) Order 2021

THE MINISTER FOR HEALTH AND SOCIAL SERVICES makes this Order under Regulations 2 and 3 of the Covid-19 (Workplace Restrictions) (Jersey) Regulations 2020[1], after complying with the consultation requirements set out in Regulation 2(1) and (2) of those Regulations and under Regulation 2 of the Covid-19 (Gatherings) (Jersey) Regulations 2020[2], after complying with the consultation requirements in Regulation 2(3) of those Regulations –

1        Covid-19 (Workplace Restrictions) (Jersey) Order 2020 amended

Articles 2 to 11 amend the Covid-19 (Workplace Restrictions) (Jersey) Order 2020[3].

2        Article A1 (interpretation) amended

In Article A1(1) –

(a)     after the definition “amusement centre” there is inserted –

“ “entertainment facility” means the auditorium of a concert hall, dance hall, theatre, cinema and the like;”;

(b)     for the definition “indoor area” there is substituted –

“ “indoor area” means an area, room or other structure (including a marquee or stadium) that has a roof and is closed on more than one side;”.

3        Article 2 substituted

For Article 2 there is substituted –

“2      Closure of certain workplaces

Jacuzzis, plunge pools, steam rooms, saunas, Turkish baths, and the like are prohibited from being open to the public.”.

4        Article 3 (specified workplaces open to the public for certain purposes or subject to specified conditions) amended

Article 3(1)(c), (f) and (g), (1A)(c) and (5) and (6) are deleted.

5        Article 4 (other workplaces permitted to be open) substituted

For Article 4 there is substituted –

“4      General provisions on opening and closing of workplaces

(1)     No workplace may be open to the public unless the occupier or operator of the workplace has taken all reasonable steps to assist in controlling the spread of Covid‑19, including taking account of any relevant guidance.

(2)     Any workplace that is not prohibited from being open under any other provision of this Order may be open.”.

6        Article 5 (visitors required to wear masks) amended

In Article 5(3) –

(a)     sub-paragraph (d) is deleted;

(b)     at the beginning of sub-paragraphs (a), (f), (fa), (g), (k) and (n) there is inserted “indoor areas of”;

(c)     in sub-paragraph (o) for “45 people” there is substituted “50 people”;

(d)     after sub-paragraph (o) there is inserted –

“(p)    indoor areas of entertainment facilities.”.

7        Article 5A (condition of opening: workers wearing masks or visors) amended

In Article 5A(2) –

(a)     in sub-paragraph (k) for “45 people” there is substituted “50 people”;

(b)     after sub-paragraph (k) there is inserted –

“(l)     entertainment facilities.”.

8        Article 5B (conditions of opening: visitors giving contact tracing data) amended

In Article 5B(2) –

(a)     for sub-paragraph (d) there is substituted –

“(d)    indoor physical activity facilities;”;

(b)     in sub-paragraph (g) for “45 people” there is substituted “50 people”;

(c)     after sub-paragraph (g) there is inserted –

“(h)    entertainment facilities.”.

9        Article 5C (condition of opening: distancing in workplaces) deleted

Article 5C is deleted.

10      Article 5D substituted

For Article 5D there is substituted –

(1)     The requirements of Article 5 or 5B do not apply in respect of children participating in –

(a)     a gathering of up to 10 children (not counting children under the age of 5 and adults organising the gathering) for the purpose of an activity specifically for those children;

(b)     a gathering of any number of children for the purposes of –

(i)      education or before or after school activity provided by a school, or

(ii)      registered day care of children,

including for the purposes of travel in connection with that education, activity or registered day care; or

(c)     a gathering of any number of children organised by the Jersey Youth Service administered by the Department of Children, Young People, Education and Skills, including for the purposes of travel in connection with that gathering.

(2)     In this Article “registered day care” means looking after children as a day carer registered under the Day Care of Children (Jersey) Law 2002[4] or in day care accommodation registered under that Law, but a gathering is not disqualified from being for the purposes of registered day care of children merely because some (but not all) of those children are aged 12 or older.”.

11      Article 5E inserted

After Article 5D there is inserted –

“5E    Exception from mask-wearing for certain performers

The requirements of Article 5 or 5A do not apply to people present in a workplace for the purposes of rehearsing or performing theatrical works, recitations or music consisting of singing or playing a woodwind or brass instrument, while they are actually acting, reciting, singing or playing their instrument, preparing to do so, or in the process of finishing their rehearsal or performance.”.

12      Covid-19 (Gathering Control) (Jersey) Order 2020 amended

Articles 13 to 15 amend the Covid-19 (Gathering Control) (Jersey) Order 2020[5].

13      Article 3 (gatherings in people’s homes) amended

In Article 3 –

(a)     in paragraphs (1) and (2)(b) for “10 people” there is substituted “20 people”;

(b)     after paragraph (2) there is inserted –

“(3)    Paragraph (1) does not apply to a gathering in the associated garden, yard or other outdoor space of no more than 50 people for the celebration of a marriage or civil partnership, but does apply to a reception or other event commonly associated with that celebration.”.

14      Article 4 (gatherings in the open air) amended

In Article 4 –

(a)     in paragraph (1) for “10 people” there is substituted “20 people unless the gathering is a controlled gathering”;

(b)     in paragraph (1A)(b) for “10 people” there is substituted “20 people”;

(c)     after paragraph (2) there is inserted –

“(3)    In this Article –

“controlled gathering” means a gathering at which a responsible person has taken all reasonable steps to assist in controlling the spread of Covid‑19;

“responsible person” means –

(a)     a person responsible for organising the gathering; or

(b)     an operator or occupier (within the meaning of Regulation 1(1) of the Covid-19 (Workplace Restrictions) (Jersey) Regulations 2020[6]) of the location where the gathering takes place.

(4)     In assessing whether a responsible person has taken all reasonable steps, for the purpose of the definition “controlled gathering”, any guidance published by the Medical Officer of Health as to factors that increase the risk of spread of Covid‑19 in gatherings must be taken into account.”.

15      Articles 5, 6 and 8 deleted

The following Articles are deleted –

(a)     Article 5 (gatherings in certain workplaces);

(b)     Article 6 (gatherings in other locations);

(c)     Article 8 (exception: certain gatherings involving young people).

16      Citation and commencement

This Order may be cited as the Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 5) (Jersey) Order 2021 and comes into force on 12th April 2021.
