Covid-19 (Gathering Control Repeal and Workplace Restrictions Amendment) (Jersey) Order 2021

THE MINISTER FOR HEALTH AND SOCIAL SERVICES makes this Order under Regulation 2 of the Covid-19 (Gatherings) (Jersey) Regulations 2020, after complying with the consultation requirements in Regulation 2(3) of those Regulations and under Regulations 2 and 3 of the Covid-19 (Workplace Restrictions) (Jersey) Regulations 2020, after complying with the consultation requirements set out in Regulation 2(1) and (2) of those Regulations –

1        Gathering Control Order repealed

The Covid-19 (Gathering Control) (Jersey) Order 2020 is repealed.

2        Workplace Restrictions Order amended

(1)     This Article amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 .

(2)     in Article A1(1) –

(a)     after the definition “amusement centre” there is inserted –

“ “close contact premises” means a building –

(a)     other than a school or day care accommodation (within the meaning of the Day Care of Children (Jersey) Law 2002) –

(b)     where a visitor receives a service from an individual that –

(i)      is provided by the individual as a doctor, nurse, hairdresser or tattooist, or

(ii)      otherwise involves, or is of a nature that normally involves, touching the visitor or spending more than 15 minutes closer than 2 metres to the visitor;”;

(b)     the definitions “market” and “retail premises” are deleted;

(c)     after the definition “ritual gathering” there is inserted –

(3)     Article 3 is deleted.

(4)     For Article 5(2), (3) and (4) there is substituted –

“(3)    This Article applies to public transport vehicles or premises, being workplaces that are –

(a)     public service vehicles, within the meaning of the Motor Traffic (Jersey) Law 1935;

(b)     bus stations; or

(c)     buildings used for port operations, within the meaning of the Air and Sea Ports (Incorporation) (Jersey) Law 2015, relating to passengers, other than a building in which the visitor remains inside a vehicle.”.

(5)     In Article 5A –

(a)     for paragraphs (2), (2A) and (3) there is substituted –

“(2)    This Article applies to public transport vehicles or premises (within the meaning of Article 5(3)) except that the driver of a public service vehicle need not wear a mask or visor when doing so would make driving unsafe.”;

(b)     paragraph (5) is deleted.

(6)     In Article 5B –

(a)     For paragraph (1) there is substituted –

“(1)    A workplace to which this Article applies, that is permitted to be open under any other provision of this Order, may remain open only on the condition that this Article is complied with.”;

(b)     in paragraph (2)(a) after “food and drink premises” there is inserted “(including nightclubs)”;

(c)     after paragraph (2)(i) there is inserted –

“(j)     visitor attractions;

(k)     auction houses.”;

(d)     after paragraph (2) there is inserted –

“(2A) The occupier or operator of the workplace must require –

(a)     at least one visitor aged 12 or over in every party of visitors that has such a visitor and is attending the workplace as a group; and

(b)     every visitor aged 12 or over attending the workplace singly,

to provide or have provided relevant personal data before arriving, on arrival or as soon as practical after arriving at the workplace.”;

(e)     paragraph (9) is deleted.

3        Citation and commencement

This Order may be cited as the Covid-19 (Gathering Control Repeal and Workplace Restrictions Amendment) (Jersey) Order 2021 and comes into force on 26th August 2021.
