Home Affairs (Fire and Rescue and Petroleum – 2017 Fees) (Jersey) Order 2016

THE MINISTER FOR HOME AFFAIRS, in pursuance of Article 15 of the Fire and Rescue Service (Jersey) Law 2011[1], Article 15(1)(b) of the Fire Precautions (Jersey) Law 1977[2] and Article 3(3) of the Petroleum (Jersey) Law 1984[3], orders as follows –

1        Fire and Rescue Service (Charges) (Jersey) Order 2012 amended

For the Schedule to the Fire and Rescue Service (Charges) (Jersey) Order 2012[4] there shall be substituted the following Schedule –

Where the provision of technical fire safety advice described in Article 2 requires the use of the following appliances and personnel of the Fire and Rescue Service –

 

(a)

light portable pump and 1 operator

(a)     £152

(b)

light appliance and crew (1 to 2 personnel)

(b)     £226

(c)

standard or special appliance and crew (1 to 2 personnel)

(c)     £242

(d)

standard appliance or rescue boat and crew (4 to 5 personnel)

(d)     £305

(e)

aerial ladder platform and crew (2 personnel)

(e)     £379

Note: Charges for Fire and Rescue Service appliances and personnel services are per hour or part hour commencing from the vehicle and personnel leaving the fire station and ending at the time of return of the vehicle and personnel to the fire station. The charges include the use of all equipment carried as normal complement. An additional charge will be made for any other expenditure incurred, including the costs of materials supplied or repairs to appliances and equipment that are directly attributable to the service rendered.

Where the provision of technical fire safety advice described in Article 2 requires the use of the following personnel of the Fire and Rescue Service –

 

(a)

any interview with Fire and Rescue Service officers at the rank of station manager or above

(a)     £114 per hour per officer interviewed

(b)

any interview with Fire and Rescue Service Officers below the rank of station manager

(b)     £85 per hour per officer interviewed

Note: the minimum charge for Fire and Rescue Service personnel services is for 1 hour, and the service is charged per quarter hour thereafter. Interview includes an interview in connection with an investigation, research or any other purpose.

Where the provision of technical fire safety advice described in Article 2 requires the use of the Fire and Rescue Service training room and training facilities –

(a)     £170 for over 4 hours use of training room in a day

 

(b)     £114 for up to 4 hours use of training room in a day

Where the provision of technical fire safety advice described in Article 2 requires the use of the Fire and Rescue Service personnel and administrative services for the provision of documents, photographs, tapes, videos or other similar recordings –

 

(a)

the provision of a copy of a fire report or other incident report

(a)     £152 per report

(b)

the provision of documents, photos, tapes, videos, or other similar recordings

(b)     £114

Where provision of technical fire safety advice described in Article 2 requires the Fire and Rescue Service to provide technical fire safety advice, other than training –

 

(a)

inspection of any commercial, trade, professional or public premises, and the provision of a fire safety report in respect of such inspection

(a)     £80 for premises with a floor area of 100 square metres or less, or 80 pence per square metre for premises with a floor area of more than 100 square metres

(b)

technical fire safety advice or consultation

(b)     £114

 

Note: the charge for providing technical fire safety advice or consultation is per hour. The minimum charge is for 1 hour, and the service is charged per quarter hour thereafter. The charge applies in respect of preparation and research time as well as the time during which advice is given.

(c)

search of Fire and Rescue Service records to establish whether any material or information is held by the Fire and Rescue Service in respect of any premises

(c)     £114

 

Note: the charge for a search of the Fire and Rescue Service records includes the cost of providing a report as to whether any material or information is held by the Service, and the nature of any such material or information, but excludes the provision of a fire or other incident report or any other documents held.

Where the action is for the provision of training –

The provision of training at any premises of the Fire and Rescue Service by one or more personnel of the Fire and Rescue Service –

The provision of training at any premises not being premises of the Fire and Rescue Services by one or more personnel of the Fire and Rescue Service –

Personnel charges for the preparation of bespoke training

3        £114 per hour

Note: The minimum charge for preparation of bespoke training is for 1 hour, and is charged per quarter hour thereafter. The charge applies in respect of research and preparation time and is in addition to the charge for the delivery of any bespoke training as set out in paragraphs 1 and 2.

Note: Charges for Fire and Rescue Service appliances and personnel services are per hour or part hour commencing from the vehicle and personnel leaving the fire station (or where the appliance and personnel are already at the place where the assistance is to be given, at the time when the assistance commences) and ending at the time of return of the appliance and personnel to the fire station. The charges include the use of all equipment carried as normal complement. An additional charge will be made for any other expenditure incurred, including the costs of materials supplied or repairs to appliances and equipment that are directly attributable to the service rendered.

Charge for responding to malfunctioning automatic fire alarm

£305”.

2        Fire Precautions (Fees) (Jersey) Order 2010 amended

In the Fire Precautions (Fees) (Jersey) Order 2010[5] for the table in the Schedule there shall be substituted the following table –

3        Petroleum (Licensing) (Fees) (Jersey) Order 2012 amended

In the Petroleum (Licensing) (Fees) (Jersey) Order 2012[6] for the table in Article 1(1) there shall be substituted the following table –

 

“(a)

in the case of an application to keep petroleum-spirit at premises comprising a bulk fuel storage depot

£2,759

(b)

in the case of an application to keep petroleum-spirit at premises for the purposes of distribution to premises used for dispensing petroleum-spirit for retail or private supply or to a person for private use

£1,103

(c)

in the case of an application to keep petroleum-spirit at premises used for dispensing petroleum-spirit for retail or private supply, not being premises falling within the description in paragraph (b)

£220, plus £54 per petroleum dispenser used at the premises for such supply”.

4        Citation and commencement

This Order may be cited as the Home Affairs (Fire and Rescue and Petroleum – 2017 Fees) (Jersey) Order 2016 and comes into force on 1st January 2017.
