Fire and Rescue Service (Emergencies and Humanitarian Services) (Jersey) Order 2012

THE MINISTER FOR HOME AFFAIRS, in pursuance of Articles 10 and 11 of the Fire and Rescue Service (Jersey) Law 2011[1], orders as follows –

1        Interpretation

In this Order “Law” means the Fire and Rescue Service (Jersey) Law 2011[2].

2        Water rescue services

The Minister, in so far as provision is not required to be made under Article 7, 8 or 9 of the Law, and to the extent that the Minister considers it reasonable to do so, may make provision in Jersey for the purposes of locating or rescuing people and protecting them from serious harm in the event of –

(a)     any incident occurring within 3 nautical miles from the mean high water mark of the ordinary spring tides on the coasts of Jersey;

(b)     any incident involving any reservoir, lake or other watercourse; and

(c)     serious flooding as a result of natural causes or escape of water.

3        Search and rescue services

The Minister, in so far as provision is not required to be made under Article 7, 8 or 9 of the Law, and to the extent that the Minister considers it reasonable to do so, may make provision in Jersey for the purposes of locating or rescuing people and protecting them from serious harm in the event of –

(a)     any incident involving the collapse of a building, tunnel or other structure;

(b)     any landslide or other natural disaster;

(c)     any serious transport accident or incident; and

(d)     any other serious incident that requires, or would be facilitated by, the use of the services or equipment of the States of Jersey Fire and Rescue Service.

4        Incidents involving hazardous materials

The Minister, in so far as provision is not required to be made under Article 7, 8 or 9 of the Law, and to the extent that the Minister considers it reasonable to do so, may make provision in Jersey for the purposes of –

(a)     removing any chemical, biological, radio-active or other hazardous materials from people;

(b)     protecting people from harm from such materials; and

(c)     preventing or limiting harm to the environment from such materials.

5        Assistance to other emergency services

The Minister, in so far as provision is not required to be made under Article 7, 8 or 9 of the Law, and to the extent that the Minister considers it reasonable to do so, may make provision in Jersey for the purposes of –

(a)     providing immediate emergency care to any person suffering from a life-threatening condition; and

(b)     providing assistance to any emergency service.

6        Humanitarian Services

The Minister, in so far as provision is not required to be made under Article 7, 8 or 9 of the Law, or under Articles 2, 3, 4 or 5, and to the extent that the Minister considers it reasonable to do so, may make provision in Jersey for the purposes of –

(a)     rescuing any person trapped in a lift car;

(b)     assisting any person to gain access to, or egress from, premises;

(c)     rescuing any animal;

(d)     assisting in the removal or detachment of any object from the body of any person in order to prevent or reduce the risk of harm or distress to such person;

(e)     removing flood water from premises;

(f)      making safe buildings or structures or fixtures to buildings or structures;

(g)     providing non-urgent medical assistance to any person;

(h)     removing, containing or washing away any debris, spillages or non-hazardous material that does not threaten life or the environment;

(i)      pumping water;

(j)      supplying water.

7        Citation

This Order may be cited as the Fire and Rescue Service (Emergencies and Humanitarian Services) (Jersey) Order 2012.
