THE MINISTER FOR
PLANNING AND ENVIRONMENT, in pursuance of Article 30 of the Planning and Building (Jersey)
Law 2002[1], orders as follows –

1 Minister to invite comment on draft
Building Bye-laws
(1) Before
making Building Bye-laws or any amendment of Building Bye-laws, the Minister
shall publish notice of his or her intention to make the Bye-laws or the
amendment.
(2) The
notice shall be published in a way that is likely to bring it to the attention
of those who will be affected by the Building Bye-laws or the amendment.
(3) The
notice must –
(a) state
that the Minister intends to make the Building Bye-laws or the amendment;
(b) state
where a copy of a draft of the proposed Building Bye-laws or the amendment may
be viewed or obtained; and
(c) invite
written comments in respect of the draft before a date specified in the notice.
(4) The
date mentioned in paragraph (3)(c) must not be sooner than 14 days
after the first publication of the notice.
2 Minister
to consider comments received
(1) The
Minister –
(a) shall
consider all written comments received before the date mentioned in
Article 1(3)(c); and
(b) may
invite any person so commenting to provide further written information.
(2) Before
making the Building Bye-laws or the amendment the Minister shall publish a
notice specifying –
(a) any
action he or she has taken in respect of each comment received and the reason
for taking the action; and
(b) where
the Minister has taken no action in respect of a comment, the reason for not
taking any action.
(3) The
notice shall be published in a way that is likely to bring it to the attention
of those who commented on the Building Bye-laws or the amendment.

This Order may be cited as the Planning and Building (Building
Bye-laws) (Jersey) Order 2007.
