(Fees) (Jersey) Order 2018

THE CHIEF MINISTER, in pursuance of Article 41 of the Regulation of Care (Jersey)
Law 2014[1], orders as follows –
1 Fees for application for registration as
provider or manager
The Table in this Article sets out the fees payable for each
application for registration as provider or manager in respect of a regulated
activity.

2 Annual
fees
(1) The
Table in this Article sets out the annual fees payable for each regulated
activity by the categories of providers undertaking the activity.

(2) However,
if a provider is registered after 31st March in any year the fee payable is as
follows –
(a) where
the application is received between 1st April and 30th June, 75% of the fee
otherwise payable but for this paragraph;
(b) where
the application is received between 1st July and 30th September, 50% of the fee
otherwise payable but for this paragraph; and
(c) where
the application is received between 1st October and 31st December, 25% of the
fee otherwise payable but for this paragraph.
(3) Despite
paragraph (1) if a provider was registered under the 1978 Law or the
1994 Law and has not cancelled that registration by 1st February 2019, an
annual fee is payable for 2019 that is 50% of the fee that would have been payable
under the 1978 Law or the 1994 Law (as the case may be) had that
registration continued plus 50% of the fee otherwise payable under paragraph (1).
(4) In
this Article –
“small charity care home” means a provider –
(a) that
is a registered charity within the meaning of Article 1 of the Charities (Jersey)
Law 2014[2];
(b) that
has no more than 10 beds in total available for use as part of the care home
service;
(c) whose
sole activity is the provision of that service;
(d) that
charges fees to its care receivers that are no more than the fees that would be
charged for long-term care services under the Long-Term Care (Health and Social
Services Charges) (Jersey) Law 2014[3] for each such care receiver;
(e) that
does not charge its care receivers for any supplementary or top-up services;
and
(f) that
does not hold any contract for services with, nor receives any form of grant or
aid from, any administration of the States of Jersey;
“small provider” means a home care service that provides
an aggregate amount of care to all its care receivers of no more than 112 hours
in any week;
“medium provider” means a home care service that provides
an aggregate amount of care to all its care receivers of more than 112 hours
but not more than 600 hours in any week;
“medium plus provider” means a home care service that
provides an aggregate amount of care to all its care receivers of more than 600 hours
but not more than 2,250 hours in any week;
“large provider” means a home care service that provides
an aggregate amount of care to all its care receivers home care of more than
2,250 hours in any week.
(5) Words
and phrases used in this Article that are defined in Article 1 of the
Regulation of Care (Transitional and Transfer) (Jersey) Regulations 2018[4] have the same respective
meanings as in that Article.

4 Citation
and commencement
This Order may be cited as the Regulation of Care (Fees) (Jersey) Order 2018
and comes into force on 1st January 2019.
