Crime (Going Equipped) (Jersey) Law 2003

A LAW to create a new offence of going equipped for the commission of certain offences

Commencement [see endnotes]

1        Going equipped

(1)     A person shall be guilty of an offence if, when not at the person’s place of abode, the person has with him or her any article intended by the person for use by any person in the course of or in connection with any of the following offences –

(a)     larceny, including robbery;

(b)     breaking and entering or illegal entry;

(c)     offences under Article 53 of the Road Traffic (Jersey) Law 1956; or

(d)     fraud, obtaining by false pretences, embezzlement and fraudulent conversion.

(2)     A person guilty of an offence under this Article shall be liable to imprisonment for a term not exceeding 3 years or to a fine, or both.

(3)     Where a person is charged with an offence under this Article, proof that the person has with him or her any article made or adapted for use in committing any offence mentioned in paragraph (1) shall be evidence that the person had it with him or her for such use.

This Law may be cited as the Crime (Going Equipped) (Jersey) Law 2003.
