Provisions (Bovine Embryos) (Fees) (Jersey) Order 2011
1 Interpretation
In this Order, “Regulations” means
the Community Provisions (Bovine
Embryos) (Jersey) Regulations 2010.
2 Application
fees – approvals
(1) The fee payable for an
application for approval is –
(a) £338 in
relation to approval of an embryo collection team under Regulation 5 of
the Regulations;
(b) £338 in
relation to approval of an embryo production team under Regulation 8 of
the Regulations;
(c) £169.10 in
relation to approval of a bovine embryo storage facility under
Regulation 11 of the Regulations.[1]
(2) If an application
referred to in paragraph (1)(a) relates to more than one laboratory, the
fee is increased by an additional £224.40 in respect of each
additional laboratory.[2]
(3) A fee payable under
paragraph (1)(c) is to be reduced by any amount paid as a fee under the Bovine
Semen Order in relation to approval or licensing of the same facility for
storage of semen under that Order, if the facility is approved or licensed for
both purposes at the same time.
(4) If an application for
an approval is withdrawn before its determination, the Minister may refund all
or part of any fee paid under this Article.
3 Issue
fee – animal health certificate
(1) The fee payable for the
issue of an animal health certificate under Regulation 14 of the Regulations
is to be calculated in accordance with this Article.
(2) No fee is payable
if –
(a) the
applicant provides a completed draft of the certificate, including any
necessary translations; and
(b) an
official veterinarian other than the States Veterinary Officer issues the
certificate.[3]
(3) If paragraph (2)(a)
does not apply, the fee is £29.20.[4]
(4) If paragraph (2)(b)
does not apply, the fee is calculated at a rate of £55.30 for each
unit of half an hour or part of such a unit, during which the States Veterinary
Officer undertakes any inspection, test or official examination for the purpose
of the issue of the certificate.[5]
(5) If neither paragraph (2)(a)
nor paragraph (2)(b) applies, the fee is calculated by adding the fees set
out in paragraphs (3) and (4).
4 Inspection
fees – annual compliance checks[6]
A fee of £169 is payable for each inspection that –
(a) is carried out –
(i) by
or on behalf of an official veterinarian under Regulation 17(3) of the
Regulations, and
(ii) by
virtue of entry on premises under paragraph (1) of that Regulation for the
purpose of checking for compliance with conditions attached to or relevant to
an approval; and
(b) is the first inspection
falling within paragraph (a) to be carried out since the most recent
anniversary of the giving of that approval.
5 Citation
This Order may be cited as the Community Provisions (Bovine Embryos)
(Fees) (Jersey) Order 2011.
