
Road Traffic (St.
Brelade) (Jersey) Order 1990
PART 1
INTRODUCTORY
1 Application
This Order applies to
roads in the Parish of St. Brelade.
2 Interpretation[1]
In this
Order –
“Badges Order”
means the Road Traffic
(Disabled Persons) (Badges for Motor Vehicles) (Jersey) Order 1982;
“commercial vehicle”
means a vehicle designed or manufactured solely or mainly for purposes other
than those of a private household and includes, but not by way of limitation,
any agricultural tractor, goods vehicle, large passenger carrying vehicle,
locomotive, minibus, motor tractor or van;
“Connétable” means the Connétable of St. Brelade;
“Motor Traffic Law” means the Motor Traffic (Jersey)
Law 1935;
“parking disc”
means a parking disc of the kind described in Article 19 of the Road Traffic (St. Helier)
(Jersey) Order 1996;
“road”
includes part of a road.
PART 2
TRAFFIC CIRCULATION
3 One-way
traffic[2]
A person who drives a vehicle on a road specified in the first
column of Schedule 1 must drive in the direction specified in relation to
that road in the second column of that Schedule.
4 Prohibition
of waiting
(1) A
vehicle must not wait on any road specified in Schedule 2.[3]
(2) A
vehicle must not wait on a road within 10 yards of its junction with another
road.[4]
(3) A
vehicle, other than a public service vehicle of the appropriate class, must not
stop on any part of a road which is authorized under Article 37 of the
Motor Traffic Law as a stand for public service vehicles.[5]

(5) A
commercial vehicle must not wait on any road specified in Schedule 2A.[7]
5 Closing
of roads to through traffic[8]
A person must not drive a
vehicle on a road specified in the first column of Schedule 7 during the
times prescribed in relation to that road in the second column of that Schedule
except –
(a) for
the purpose of delivering or collecting goods or merchandise, or persons, to or
from any premises situated on or adjacent to that road;
(b) to or
from premises having a means of vehicular access from that road;
(c) if it
is a vehicle engaged in mechanical road sweeping or road gully cleaning.
6 Public
service vehicles
(1) Except
with the permission in writing of the Connétable, or on the express
direction of a police officer, a person must not drive a char-à-banc on
a road specified in Part 1 of Schedule 3.[9]
(2) Except
with the permission in writing of the Connétable, a person must not
station a char-à-banc on any road.[10]
(3) A
person must not station a cab on any road except on the express direction of a
police officer.[11]
(3A) Paragraph (3)
does not apply to a taxi-cab stationed on a taxi rank (as defined in the Motor Traffic (Cabs
– General) (Jersey) Order 2021).[12]
(4) In
this Article, “cab” and “char-à-banc” have the
same respective meanings as under the Motor Traffic Law.
7 Roads
closed to vehicles exceeding gross weight of 7½ tons[13]
A person must not drive a vehicle exceeding a gross weight of
7½ tons on a road specified in Part 2 of Schedule 3,
unless they have permission in writing from the Connétable to do so.
7A Roads
closed to vehicles exceeding width of 6 feet 6 inches[14]
A person must not drive a vehicle exceeding a width of 6 feet
6 inches on a road specified in Part 3 of Schedule 3, unless
they have permission in writing from the Connétable to do so.
8 Prohibition
or restriction of turns
(1) A
person must not drive a vehicle so as to make a right-hand turn from a road
specified in the first column of Part 1 of Schedule 4 into a road
specified opposite that road in the second column of that Part.[15]
(2) A
person must not drive a vehicle so as to make a left-hand turn from a road
specified in the first column of Part 2 of Schedule 4 into a road
specified opposite that road in the second column of that Part.[16]
(3) A
person must not drive a vehicle so as to enter Les Quennevais Parade from the
northernmost exit of Les Quennevais Park.[17]
PART 3[18]
PARKING LIMITS ON ROADS THAT REQUIRE PARKING DISCS
9 Interpretation[19]
In this Part –
“parking”
means leaving a vehicle, whether attended or unattended, and includes stopping
a vehicle to load or unload goods or merchandise, but does not include stopping
a vehicle to set down or pick up passengers;
“standard
hours” means from 8.00 am to 5.30 pm on any day other than a
Sunday;
“vehicle”
excludes a pedal cycle as defined by Article 1(1) of the Road Traffic (Jersey)
Law 1956.
10 Parking
limits on roads that require parking discs[20]
(1) A person must not park
a vehicle on a road specified in Schedule 5 unless this Article is
complied with.
(2) The person must display
a parking disc in accordance with Article 12.
(3) The vehicle’s overall
width must not exceed 6 feet 6 inches.
(4) For a road specified in
Part A1, 1, 1A or 2 of Schedule 5 –
(a) the
person must not park on the road during standard hours for longer than –
(i) 20 minutes,
if specified in Part A1,
(ii) one
hour, if specified in Part 1,
(iii) 2 hours,
if specified in Part 1A, or
(iv) 3 hours,
if specified in Part 2; and
(b) once
the parked vehicle leaves, it must not be parked on the same road during
standard hours within one hour after it left.
(5) For a road specified in
Part 3 of Schedule 5 –
(a) the
person must not park on the road for longer than 12 hours; and
(b) once
the parked vehicle leaves, it must not be parked on the same road within
24 hours after the parking started.

12 Indication
of time on, and display of, parking discs
(1) If
a person parks a vehicle on a road specified in Schedule 5, they must display
a parking disc that indicates when the vehicle arrived there –
(a) against
the internal face of the vehicle’s windscreen or, if the vehicle has no
windscreen, at a convenient place on the left or near side of the vehicle; and
(b) so that
the vehicle’s arrival time may be distinctly seen by any person outside
the vehicle.[22]
(2) If
a vehicle is parked on a road specified in Schedule 5, a person must not –
(a) display
more than one parking disc on the vehicle;
(b) indicate
on the parking disc a time different from that at which the vehicle was parked;
(c) alter
the time of arrival indicated on a parking disc whilst the vehicle is parked on
that road.[23]
PART 4
LOADING AND UNLOADING OF VEHICLES
13 Parking
limited to vehicles loading and unloading[24]
(1) Unless
all the conditions in paragraph (2) are met, a person must not park a
vehicle –
(a) on a
road specified in columns 1 and 2 of the table in Schedule 6; and
(b) at a
time falling with a period specified in column 3 of that table.[25]
(2) The
conditions are that –
(a) the
vehicle is being loaded or unloaded in connection with a trade or business
carried on in the vicinity;
(b) the
vehicle is parked for no longer than one hour at any one time;
(c)
(d) there
is displayed on the internal face of the windscreen of the vehicle or, if the
vehicle has no windscreen, at a convenient place on the left or near side of
the vehicle, and in such manner as to be distinctly seen by any person outside
the vehicle –
(i) a parking disc
indicating the time at which the vehicle was parked, and
(ii) the
business name and address of the user of the vehicle.[26]
(3) The
condition in paragraph (2)(d)(i) is not met if –
(a) more
than one parking disc is displayed;
(b) more
than one time is indicated; or
(c) the
time indicated is altered while the vehicle remains parked.
Part 4A[27]
RESIDENTIAL PARKING IN
PARKING ZONES
13A Interpretation
In this Part –
“Les Quennevais
Park” means the row of houses, starting from number 10 and ending
with number 29 and starting from number 39 and ending with
number 58, marked on the plan set out in Schedule 9;
“Les Quennevais
Park parking zones” means the 2 areas coloured in red on the plan
set out in Schedule 9;
“Connétable”
means the Connétable of St. Brelade;
“permit holder”
means a resident of Les Quennevais Park in respect of whom a
resident’s parking permit is issued under Article 13F;
“resident’s
parking permit” and “parking permit” means a permit that
permits parking in the zones at any time;
“zones” means
the Les Quennevais Park parking zones.
13B Use of parking
places restricted to permit parking
(1) A
person must not park a vehicle at any time in a parking place in the zones
unless the vehicle is parked displaying a resident’s parking permit which –
(a) applies
in respect of that vehicle; and
(b) is in
force.[28]
(2) Subject
to paragraph (3), a vehicle displaying a resident’s parking permit must
not remain parked in the same parking place, without being moved, for a period
of more than 4 weeks commencing on the date the vehicle was first parked
in that parking place.[29]
(3) The
Connétable may, on a written request by the permit holder setting out
reasons for the request, extend the period specified in paragraph (2) for
a period not exceeding 4 weeks.
13C Application
for parking permit
Subject to Article 13D,
a person who –
(a) resides
in Les Quennevais Park; and
(b) keeps
or owns one or more vehicles that is registered to that person’s address
in Les Quennevais Park,
may apply in writing to the
Connétable for a resident’s parking permit for the zones in
respect of any such vehicle.
13D Restrictions on
issue of parking permit
(1) Subject
to a maximum number of 60 resident’s parking permits being available
for issue, only one person per household may apply for not more than 2 parking
permits under Article 13C.
(2) A
parking permit may apply in respect of more than one vehicle but is not
otherwise transferable.
13E Fee for parking
permit
(1) The
annual fee for a resident’s parking permit is £100 per permit.[30]
(2) If
a parking permit is to be in force for less than 12 months, the fee
payable for each month for which the permit is to be in force is an amount
calculated pro rata for the amount prescribed under paragraph (1).[31]
13F Issue of parking
permit
(1) Subject
to Article 13D(1) and the provisions of this Article, on payment of the
fee prescribed under Article 13E the Connétable must issue a
resident’s parking permit to the applicant.[32]
(2) Resident’s
parking permits must not be issued if –
(a) the
Connétable is not satisfied that the applicant for the parking permit
satisfies the criteria specified in Article 13C; or
(b) a vehicle
to which the application relates is –
(i) a commercial
vehicle the unladen weight of which exceeds 2,500 kg, or
(ii) a
camper-van, caravan, motorhome or other similar vehicle.[33]
(3) The
Connétable may decline to issue a resident’s parking permit to an
applicant if, in relation to a parking permit previously issued to that person,
a contravention of Article 13B has occurred.
(4) The
Connétable may give preference to an applicant who is the holder of a
disabled person’s badge issued under the Road Traffic (Disabled Persons)
(Badges for Motor Vehicles) (Jersey) Order 1982.
13G Form of parking permit
(1) Subject
to paragraph (2), a resident’s parking permit must be in the form
specified from time to time by the Connétable.[34]
(2) A
parking permit must specify –
(a) that
it is a resident’s parking permit;
(b) the zones
to which the parking permit relates;
(c) the
registration number of the vehicle or vehicles in respect of which the parking
permit applies;
(d) the
date on which the parking permit begins to have effect; and
(e) the
date on which the parking permit ceases to have effect.[35]
13H Duration of parking
permit
(1) Subject
to paragraph (2), a resident’s parking permit is valid from the date
on which it is issued up to and including 30th April.
(2) A
parking permit ceases to have effect –
(a) if
the permit holder ceases to reside in Les Quennevais Park; or
(b) if
the permit holder ceases to keep or own the vehicle in respect of which the
parking permit applies, or, if the parking permit applies in respect of more
than one vehicle, the permit holder ceases to keep or own all of the vehicles
in respect of which the permit applies.[36]
(3) A
permit holder must, within 10 days of the parking permit ceasing to have
effect by virtue of paragraph (2), surrender it to the Connétable
for cancellation.[37]
13I Additional
vehicle or change of vehicle[38]
(1) Paragraph (2)
applies if a permit holder –
(a) applies
to the Connétable in writing for the issue of a resident’s parking
permit to apply in respect of –
(i) a vehicle (the
“replacement vehicle”) that replaces a vehicle to which the
existing parking permit applies; or
(ii) an
additional vehicle that is kept or owned by the permit holder; and
(b) surrenders
their existing parking permit to the Connétable.
(2) The Connétable
must, without further charge, issue an amended parking permit to the permit holder
that applies –
(a) to
the replacement vehicle or the additional vehicle; and
(b) for
the unexpired period of the surrendered parking permit.
13J Change of
address[39]
A permit holder must,
within 10 days of changing their residential address in Les Quennevais
Park, inform the Connétable in writing.
PART 5
MISCELLANEOUS
14 Saving
(1) Article 4
and Parts 3 and 4 do not apply –
(a) so as
to prevent a vehicle waiting on any road for so long as may be necessary to
enable the vehicle, if it cannot be used for such purpose without waiting on
that road, to be used in connection with any building operation or demolition
work, the removal of any obstruction or potential obstruction to traffic, the
maintenance, improvement or reconstruction of that road, or the erection,
laying, placing, maintenance, testing, alteration, repair or removal of any
structure, works or apparatus in, on, under or over that road;
(b) to
any vehicle whilst it is being used for fire brigade, ambulance or police
purposes;
(c) to
any vehicle being used for the purpose of delivering or collecting postal
packets as defined in Article 1 of the Post Office (Jersey) Law 1969;
(d) so as
to prevent a public service vehicle waiting on a part of any road which is
authorized in accordance with Article 37 of the Motor Traffic Law as a
stand for public service vehicles;
(e) so as
to prevent a vehicle waiting on any road for so long as may be necessary to
enable the vehicle, if it cannot be used for such purpose without waiting on
that road, to be used in connection with the collection of household refuse
from, or the clearing of cesspools at, premises situated on or adjacent to that
road;
(f) to
a vehicle waiting on any road while any gate or other barrier at the entrance
to premises to which the vehicle requires access or from which it has emerged
is being opened or closed, if it is not reasonably practicable for the vehicle
to wait otherwise than on that road while such gate or barrier is being opened
or closed;
(g) to a
vehicle waiting on any road on the express direction or with the specific
permission of a police officer.[40]
(2) Article 7
does not apply to any vehicle whilst it is being used for fire brigade,
ambulance or police purposes.[41]
