ROYAL COURT OF
JERSEY
FD 12/03
OMISSION OF
INFORMATION FROM PETITION/CAUSE APPLICATION
Where
it is desired to omit from a petition/cause application any information
required to be contained therein by Rule 5 of the Matrimonial Causes 2005 or
Rule 5 of the Civil Partners Causes Rules 2012, and particularly, where
necessary for the protection of a petitioner, to omit the petitioner's place of
residence, the petition should be filed without such information, but before
service is effected an ex parte application must be
made to the Greffier for leave for the petition to
stand. If leave is refused the Greffier will make an
order requiring the petition to be amended.
The
Greffier may require an affidavit in support of the
application to be filed.
Where
leave for the omission of a petitioner's place of residence is granted, care
should be taken that the effect of the order is not nullified by information
included in other documents.
