Education (Grants and Allowances) (Academic Year 2021-2022) (Jersey) Order 2021

THE MINISTER FOR CHILDREN AND EDUCATION makes this Order under Articles 51 and 68 of the Education (Jersey) Law 1999 –

1        Interpretation

(1)     In this Order –

“2018 Order” means the Education (Grants and Allowances) (Jersey) Order 2018;

“2021 academic year” is the academic year beginning on 1st September 2021;

“single parent” means, in relation to a dependent student living in the student’s main residence in Jersey, the student’s parent who lives in that main residence with the student, there being no other parent or relevant person also living in that main residence.

(2)     Words or expressions not otherwise defined have the same definition as in the 2018 Order.

2        Application

(1)     Despite Article 4 (meaning of relevant income of dependent student) of the 2018 Order, this Order applies in respect of a case described in paragraph (2), and paragraph (1) of Article 4 of the 2018 Order is disregarded for the purposes of this Order.

(2)     The case is where –

(a)     an application is made for a grant or an allowance relating to the 2021 academic year; and

(b)     the dependent student to whom the application relates lives with a single parent.

3        Relevant income for the purposes of this Order

(1)     In a case to which this Order applies, Article 4(2) of the 2018 Order is disregarded.

(2)     For the purposes of this Order, the relevant income in respect of a dependent student for the 2021 academic year is the student’s single parent’s gross income for the 2020 calendar year.

(3)     Despite the disregard of Article 4(2), paragraphs (3) to (6) of Article 4 continue to apply to a case under this Order, and references to “parent” in those paragraphs are construed as references to “single parent”.

5        Citation, commencement and expiry

(1)     This Order may be cited as the Education (Grants and Allowances) (Academic Year 2021-2022) (Jersey) Order 2021.

(2)     This Order comes into force on the day after it is made and expires on 31st August 2022.
