International Co-operation (Protection from Liability) (Jersey) Order 2024

THE CHIEF MINISTER makes this Order under Article 2(4) of the International Co-operation (Protection from Liability) (Jersey) Law 2018 –

Commencement [see endnotes]

1        Interpretation

In this Order –

“costs” means the amount of costs in respect of assistance in legal proceedings that the parties to the proceedings agree or, in the absence of agreement, that the Court determines to allow on taxation on the indemnity basis or standard basis in accordance with –

(a)     the Royal Court Rules 2004 (the “Royal Court Rules”);

(b)     the Court of Appeal (Civil) Rules 1964; or

(c)     the Rules of the Judicial Committee of the Privy Council;

“Court” means the Royal Court, Court of Appeal or Judicial Committee of the Privy Council;

“indemnity basis” means the basis of taxation of costs described in Rule 12/5 of the Royal Court Rules;

“Law” means the International Co-operation (Protection from Liability) (Jersey) Law 2018;

“standard basis” means the basis of taxation of costs described in Rule 12/4 of the Royal Court Rules.

2        Costs excluded from application of Law[1]

Costs that are excluded from the application of the Law are –

(a)     costs below £50,000;

(b)     costs of £50,000 or more, but only to the extent that the person claiming recovery of those costs can demonstrate to the Court’s satisfaction that the costs will cause the person financial hardship if they are not recovered; or

(c)     costs of £50,000 or more, if the person claiming recovery of those costs can demonstrate to the Court’s satisfaction that the public authority acted unreasonably in the conduct of the legal proceedings giving rise to the costs.

2A     Exception to Article 2[2]

Article 2 does not apply to costs in legal proceedings in respect of an act done in the discharge, or purported discharge, of a public authority’s functions under the Taxation (Implementation) (Jersey) Law 2004 or Regulations or Orders made under it.

3        Citation and commencement

This Order may be cited as the International Co-operation (Protection from Liability) (Jersey) Order 2024 and comes into force on 4th June 2024.
