Single-Use
Plastics etc. (Exemptions) (Jersey) Order 2025
1 Interpretation
In this Order, “Law”
means the Single-Use Plastics etc.
(Restrictions) (Jersey) Law 2021.
2 Certain bags exempt
from Articles 2 and 4 of Law
(1) Articles 2 (trader must not supply certain single-use
or non-recyclable items) and 4 (trader must not import certain single-use or
non-recyclable items) of the Law do not apply to a prohibited item
(excluding a single-use vape) supplied, or imported to be supplied, for the
following purposes –
(a) as packaging for uncooked
meat, poultry or fish (or products made from uncooked meat, poultry or fish)
packaged on the trader’s premises;
(b) as a container for live fish
or other live aquatic animals;
(c) as a container for an item prescribed by a registered medical practitioner;
(d) to be used for the
intended purpose of food storage or containing waste (for example, freezer bags, pet waste bags, nappy sacks and refuse bin
liners);
(e) to allow compliance with
security requirements at a port (for example, sealable plastic bags used to
contain duty-free purchases and clear plastic bags used to contain liquids);
(f) as integral product
packaging in which products are sealed before supply;
(g) as
a foil-lined paper carrier bag that is a container for hot food;
(h) as a bag, which can be
purchased by an individual as a sole item without the purchase of other goods,
to be used to wrap gifts.
(2) In
this Article –
“fish” includes molluscs and crustaceans;
“port” has the meaning given in Article 1(1)
of the Customs and
Excise (Jersey) Law 1999;
“registered medical practitioner” means a person
registered as a medical practitioner under the Medical Practitioners
(Registration) (Jersey) Law 1960.
3 Certain bags donated to
charity exempt from Article 2 of Law
(1) Article 2
(trader must not supply certain single-use or non-recyclable items) of the Law
does not apply to a prohibited item (excluding a single-use vape) donated by a
trader to a registered charity, if the prohibited item was in Jersey
immediately before the commencement of the Law.
(2) In
this Article, “registered charity” has the meaning given in Article 1 of
the Charities
(Jersey) Law 2014.
4 Citation and
commencement
This Order may be cited as the Single-Use Plastics etc. (Exemptions)
(Jersey) Order 2025 and comes into force on 1 August 2025.
