Road Traffic (Motor
Cycle Helmets) (Jersey) Order 2004[1]
1 Protective
helmet to be worn[2]
Subject to Article 1A, a person driving or riding on a motor
cycle (otherwise than in a side-car) on a road must wear a protective helmet
that –
(a) complies
with a standard set out in the Schedule; and
(b) is
securely fastened to the person’s head by any fastening provided on the helmet
for the purpose.
1A Exemption[3]
The requirement under Article 1 to wear a protective helmet
does not apply to a person who, being a follower of the Sikh religion, is
wearing a turban.
2 Citation
This Order may be cited as the Road Traffic (Motor Cycle Helmets)
(Jersey) Order 2004.[4]

(Article 1(a))
Protective
helmet standards
Part 1
British Standard or equivalent
(1) A
protective helmet complies with a standard if it –
(a) conforms
with British Standard 6658:1985 as amended immediately before the date on which
this Schedule came into force; and
(b) is
marked with the number of the that Standard and the certification mark of the
British Standards Institution.
(2) A
protective helmet also complies with a standard if it complies with a European
Economic Area Member State Standard that offers equivalent safety to
BS 6658:1985 as amended up to the date on which this Schedule came into
force.
Part 2
International standards
(1) A protective helmet complies with a standard
if it complies with ECE Regulation 22.05 or 22.06 including the approval,
marking and conformity of production requirements of that Regulation (as
applies to ECE Regulation 22.05 or 22.06 as the case may be).
(2) In
this Part –
(a) “ECE
Regulation 22” means Regulation No. 22 set out in
Addendum 21 to the UN ECE Agreement;
(b) “ECE
Regulation 22.05” means ECE Regulation 22 as amended by the
series of amendments with the designation “05” and including all
amendments in force on 30 June 2000;
(c) “ECE
Regulation 22.06” means ECE Regulation 22 as amended by the
series of amendments with the designation “06” and including all
amendments in force immediately before the date on which this Schedule came
into force;
(d) “the
UN ECE Agreement” means the Agreement of the United Nations Economic
Commission for Europe concluded at Geneva on 20 March 1958 as amended
concerning the adoption of uniform technical prescriptions for wheeled
vehicles, equipment and parts which can be fitted to and/or used on wheeled
vehicles and the conditions for the reciprocal recognition of approvals granted
on the basis of these prescriptions, to which the United Kingdom is a party by
virtue of an instrument of accession dated 14 January 1963 deposited with
the Secretary General of the United Nations on 15 January 1963.
