Control of Housing and Work (Fees) (Jersey) Order 2026

THE CHIEF MINISTER makes this Order under Articles 3(4)(c)(ii), 20(3), 26(3)(b), 31(1) and 44(4)(b) of the Control of Housing and Work (Jersey) Law 2012, with the agreement of the Minister for Treasury and Resources –

1        Interpretation

(1)     In this Order –

Law” means the Control of Housing and Work (Jersey) Law 2012;

Regulations” means the Control of Housing and Work (Residential and Employment Status) (Jersey) Regulations 2025.

(2)     A reference in this Order to a status (for example, “Standard status”) is a reference to the status as defined in the Regulations.

2        Fee for determination of status

(1)     This Article sets fees for applications for determination of status under Article 3(4) of the Law.

(2)     The fee for an application for determination of Licensed status, Licensed for Lease Only status or Standard status is £88.15.

(3)     No fee is payable under paragraph (2) if the applicant –

(a)     is aged 18 years or under;

(b)     has previously had their status determined; or

(c)     has previously been issued with a registration card (under the Law as in force before the commencement of the Control of Housing and Work (Amendment) (Jersey) Law 2022).

(4)     The fee for an application for determination of Entitled status to be granted on the grounds in Regulation 5 (Entitled status on economic or social grounds) of the Regulations is £10,506.25.

(5)     No fee is payable under paragraph (4) if the applicant –

(a)     has previously had their status determined as Entitled on the grounds in Regulation 5 (Entitled status on economic or social grounds) of the Regulations; or

(b)     has been issued a registration card (under the Law as in force before the commencement of the Control of Housing and Work (Amendment) (Jersey) Law 2022) recording Entitled status based on Regulation 2(1)(e) of the Control of Housing and Work (Residential and Employment Status) (Jersey) Regulations 2013.

(6)     No fee is payable for –

(a)     determination of Permanent Entitled status;

(b)     determination of Entitled status that a person qualifies for under Regulation 4 or 6 of the Regulations; or

(c)     determination of Entitled for Work Only status.

3        Fee for business licence

(1)     No fee is payable for a resident business licence.

(2)     The fee payable for a non-resident business licence is determined by the number of days during the licence period in which the business will be operated and is as follows –

(3)     In this Article –

non-resident business licence” means the licence specified in Article 4(b) of the Control of Housing and Work (Licences and Exemptions) (Jersey) Order 2026 as the appropriate licence for a person that carries on a non-resident business;

resident business licence” means the licence specified in Article 4(a) of the Control of Housing and Work (Licences and Exemptions) (Jersey) Order 2026 as the appropriate licence for a person that carries on a resident business.

4        Fee for staffing licence

(1)     A business that has a staffing licence must pay an annual fee, determined by the maximum number of individuals with Licensed status, Licensed for Lease Only status or Standard status that the licence states may work in or for the business that has the licence (“the maximum number”).

(2)     The fee is calculated by –

(a)     multiplying the maximum number for each status by the fee for that status; and

(b)     adding together the amounts calculated under sub-paragraph (a).

(3)     The fee for each status for a business that is not an employment agency is –

(4)     The fee for each status for a business that is an employment agency is –

(a)     for workers with Standard status who are supplied by the employment agency to work in or for another business, £551.45; and

(b)     for all other workers, the fee set under paragraph (3).

(5)     No fee is payable by –

(a)     a non-profit organisation (as defined in Article 1 of the Non-Profit Organizations (Jersey) Law 2008);

(b)     a States body (as defined in Article 1 of the Public Finances (Jersey) Law 2019; or

(c)     a parish.

(6)     If the maximum number for a status varies throughout a year, the fee is calculated based on the maximum number for the status on 1 November of the year.

(7)     The fee for a year is payable by 31 December of the year.

(8)     In this Article, “employment agency” means a business that supplies workers who are employed by the business to work in or for another business.

5        Fee for application by legal person for consent to acquire land

(1)     The fee for an application by a legal person under Article 20 of the Law for consent to acquire land as a party to a specified transaction is £551.45.

(2)     No fee is payable if the consideration agreed in respect of the acquisition is less than £25,000.

6        Discretion to waive or reduce fee

If it is fair and reasonable to do so having regard to the circumstances, the Minister may waive or reduce a fee that is payable under this Order.

7        Citation and commencement

This Order may be cited as the Control of Housing and Work (Fees) (Jersey) Order 2026 and comes into force at the same time as the Control of Housing and Work (Amendment) (Jersey) Law 2022.
