
Pharmacists and
Pharmacy Technicians (Registration) (General Provisions) (Jersey) Order 2010
THE MINISTER
FOR HEALTH AND SOCIAL SERVICES, in pursuance of Articles 2, 3, 5, 6, 7(5),
14, 16, 17, 18(5), 25 and 29 of the Pharmacists and Pharmacy Technicians (Registration) (Jersey)
Law 2010, orders as
follows –

1 Interpretation
In this Order, unless the context otherwise
requires –
“Law” means the Pharmacists and Pharmacy Technicians
(Registration) (Jersey) Law 2010;
“specialist title” means a title for a pharmacist or
pharmacy technician which has been prescribed under the UK Pharmacy Order as
being a title that is only to be used by a person registered under that Order
with a particular annotation in a Register kept under that Order;
“UK Pharmacy Order” means the UK Pharmacy Order 2007
or, on and from its revocation by the UK Pharmacy Order 2010, the UK
Pharmacy Order 2010;
“UK Pharmacy Order 2007” means The Pharmacists and
Pharmacy Technicians Order 2007 of the United Kingdom (SI 289/2007);
“UK Pharmacy Order 2010” means The Pharmacy
Order 2010 of the United Kingdom (SI 231/2010);
“UK Register of Pharmacists” means Part 1 of the
register established and maintained in accordance with article 10 of the
UK Pharmacy Order 2007 or, on and from its revocation by the UK Pharmacy
Order 2010, Part 1 or 4 of the register established and maintained in
accordance with article 19 of the UK Pharmacy Order 2010;
“UK Register of Pharmacy Technicians” means Part 1
of the register established and maintained in accordance with article 21
of the UK Pharmacy Order 2007 or, on and from its revocation by the UK
Pharmacy Order 2010, Part 2 or 5 of the register established and
maintained under article 19 of the UK Pharmacy Order 2010.
2 Information
to be entered in the register
(1) The information to be
entered in the register upon the registration of a person as a pharmacist
is –
(a) the
person’s full name and home address;
(b) the
registration number assigned to the person under the UK Pharmacy Order;
(c) any
specialist title in relation to that person that is specified for the person in
the UK Register of Pharmacists; and
(d) any
condition attached to the person’s registration in the UK Register of
Pharmacists.
(2) The information to be
entered in the register upon the registration of a person as a pharmacy technician –
(a) the
person’s full name and home address;
(b) the
registration number assigned to the person under the UK Pharmacy Order;
(c) any
specialist title in relation to that person that is specified for the person in
the UK Register of Pharmacy Technicians; and
(d) any
condition attached to the person’s registration in the UK Register of
Pharmacy Technicians.
3 Information
to be entered on the list available to the public
The list to be made available under Article 3 of the Law shall
show, for each registered pharmacist and registered pharmacy technician, the
registration number assigned to that person under the UK Pharmacy Order.
4 Requirements
for registration as a pharmacist
The requirements for registration as a pharmacist are
that –
(a) the applicant is
registered in the UK Register of Pharmacists; and
(b) the applicant’s
registration described in paragraph (a) is not suspended.
5 Particulars
and documents to be provided by applicant for registration as a pharmacist
(1) An application for registration
as a pharmacist shall include the following particulars –
(a) the
applicant’s name and, if different, the name under which the applicant
intends to practise as a pharmacist;
(b) the
applicant’s home address; and
(c) the
registration number assigned to the applicant under the UK Pharmacy Order.
(2) An application for
registration as a pharmacist shall be accompanied a Certificate of Current
Professional Standing issued by the Registrar appointed under the UK Pharmacy
Order.
6 Mandatory
condition of registration as a pharmacist
(1) Paragraphs (2) and
(3) are mandatory conditions of registration as a pharmacist that the Minister
is required, by the Law, to impose.
(2) Where the registration
of a person as a pharmacist in the UK Register of Pharmacists is made
conditional on the compliance of the person with a requirement imposed under
the UK Pharmacy Order, the registration of the person under the Law shall be
conditional on the person’s compliance with that requirement, for so long
as the requirement continues to be imposed under that Order.
(3) A person registered as
a pharmacist shall, within 7 days, notify the Minister, in writing,
of –
(a) any
change in a requirement imposed on the person’s registration in the UK
Register of Pharmacists;
(b) a
requirement being imposed on the person’s registration in the UK Register
of Pharmacists; or
(c) the
person’s registration in the UK Register of Pharmacists being cancelled
or suspended.
7 Annual
return by pharmacist
The information required to be included in an annual return by a
registered pharmacist is –
(a) the person’s
current home address;
(b) confirmation that the
person has paid the fee required to remain registered in the UK Register of
Pharmacists; and
(c) confirmation of the
specialist titles annotated in the person’s registration in the UK
Register of Pharmacists.
8 Requirements
for registration as a pharmacy technician
The requirements for registration as a pharmacy technician are
that –
(a) the applicant is
registered in the UK Register of Pharmacy Technicians; and
(b) the applicant’s
registration described in paragraph (a) is not suspended.

technician

Register of Pharmacy Technicians being cancelled or suspended.
11 Annual
return by pharmacy technician
The information required to be included in an annual return by a
registered pharmacy technician is –
(a) the person’s
current home address;
(b) confirmation that the
person has paid the fee required to remain registered in the UK Register of
Pharmacy Technicians; and
(c) confirmation of any
specialist titles annotated in the person’s registration in the UK
Register of Pharmacy Technicians.
12 Transitional
arrangements: pharmacists
(1) Subject to paragraph (2),
a person who –
(a) immediately
before 16th May 2010, was entered in the list of pharmacists kept by the
Judicial Greffier under the Pharmacy and Poisons (Jersey) Law 1952; and
(b) on 16th
May 2010, fulfils the requirements for registration in Article 4,
shall be deemed to be registered as a pharmacist under the Law for
the period of 4 months commencing on 16th May 2010.
(2) Where, within the
period described in paragraph (1), the person makes an application to be
registered as a pharmacist under the Law, he or she shall be deemed to be
registered as a pharmacist under the Law until his or her application for such
registration is withdrawn or has been determined under the Law.
(3) The Minister may, in
the case of an application to be registered as a pharmacist under the Law made
within the period described in paragraph (1), waive the requirement in
Article 5(2).
(4) The powers of
suspension conferred by the Law and the mandatory conditions of registration
specified in Article 6 of this Order shall apply in the case of a person
deemed to be registered as a pharmacist under the Law by virtue of this
Article.
13 Citation
This Order may be cited as the Pharmacists and Pharmacy Technicians
(Registration) (General Provisions) (Jersey) Order 2010.
