Medicines
(Veterinary Drugs) (Jersey) Order 2011
THE MINISTER
FOR HEALTH AND SOCIAL SERVICES, in pursuance of Articles 14(2) and 110 of the Medicines (Jersey) Law 1995, after consultation with the Minister for Economic
Development and the Medicines Advisory Council and with such other
organizations as appear to the Minister to be representative of interests
likely to be substantially affected by the Order, orders as
follows –

1 Importation
of veterinary drug without product licence
(1) The restriction imposed
by Article 8(3) of the Medicines (Jersey) Law 1995 shall not apply where a
veterinary drug is imported in compliance with the terms of an authorization
issued by the Minister.
(2) An authorization shall,
subject to compliance with any conditions included under paragraph (3),
authorize importation of any drug specified in the authorization –
(a) by
any person within the class of persons specified in the authorization; or
(b) by
the person to whom the authorization is issued.
(3) An authorization may
include conditions –
(a) as to
the persons by whom any veterinary drug specified in it may be administered to
an animal;
(b) as to
the animals to which any veterinary drug specified in it may be administered;
(c) as to
the purposes for which any veterinary drug specified in it may be administered;
(d) requiring
the veterinary drug specified to have been authorized in a Member State, for
use,
and such other conditions as the Minister considers necessary to
monitor the use of any veterinary drug pursuant to the authorization and to
protect the health and welfare of animals.
(4) An authorization may be
expressed to have effect indefinitely or for a specified period.
(5) An authorization shall
be in writing.
(6) The Minister shall only
exercise his or her powers under this Order if it appears to the Minister
that –
(a) there
is an urgent need to administer a veterinary drug in the treatment of animals
for a disease or condition; and
(b) there
is no suitable veterinary drug which has a product licence.

This Order may be cited as the Medicines (Veterinary Drugs) (Jersey)
Order 2011.
