Terrorism (Proscribed Organizations – Deproscription Applications) (Jersey) Order 2003

THE HOME AFFAIRS COMMITTEE, in pursuance of Article 7(3) of the Terrorism (Jersey) Law 2002, orders as follows –

1        Interpretation

In this Order –

“application” means an application to the Minister for the exercise of the Minister’s power under Article 6(3)(b) of the Law[1] to remove an organization from Schedule 1 to the Law;

“Law” means the Terrorism (Jersey) Law 2002.

2        Application for deproscription

(1)     An application for deproscription may be made at any time after the organization in question has been proscribed.

(2)     An application shall be made in writing and shall state –

(a)     the name of the organization to which the application relates;

(b)     whether the application is being made by the organization or by a person affected by the organization’s proscription; and

(c)     the grounds on which the application is being made.

3        Application by organization: additional information

Where the application is made by the organization, the application shall also state –

(a)     the name and address of the person submitting the application; and

(b)     the position which that person holds in the organization or that person’s authority to act on behalf of the organization, and shall be signed by that person.

4        Application by person affected by proscription: additional information

Where the application is made by a person affected by the organization’s proscription the application shall also state –

(a)     the manner in which the applicant is so affected; and

(b)     the applicant’s name and address, and shall be signed by the applicant.

5        Change of address

The person whose name and address are stated under Article 3(a) or 4 shall inform the Minister if the address changes.

6        Period of determination

The Minister shall determine an application within a period of 120 days from, but excluding, the day on which the Minister receives the application.

7        Refusal to deproscribe

Where the Minister refuses an application, the Minister shall immediately inform the applicant, in writing, of the refusal and notify the applicant of the procedures for appealing against the refusal to the Proscribed Organizations Appeal Commission.

8        Citation

This Order may be cited as the Terrorism (Proscribed Organizations – Deproscription Applications) (Jersey) Order 2003.
