
Income Support
(Special Payments) (Cold Weather Payments) (Jersey) Regulations 2008
1 Interpretation[1]
In these Regulations –
“Law” means the Income Support (Jersey) Law 2007;
“long
term incapacity allowance” means the benefit described in Article 16
of the Social Security (Jersey) Law 1974.
2 Special
payments to meet heating costs
(1) A special payment may
be made to defray the expenses of heating a dwelling for any month from and
including the months of October to April that is a cold weather month to any
household occupying that dwelling where a member of the household throughout
that month –
(a) was under
the age of 3 years;
(b) was
over the age of 65 years;
(c) met
the criteria for the personal care element of the impairment component under
paragraph 6(1)(c) of Schedule 1 to the Income Support (Jersey) Regulations 2007;
(d) was a
child who met the criteria in Regulation 3(a) of the Income Support (Special
Payments) (Child Personal Care) (Jersey) Regulations 2014; or
(e) was
awarded long term incapacity allowance for total incapacitation assessed at a
degree of 100%.[2]
(2) However, no payment may
be made under this Regulation unless throughout that month the household
concerned –
(a) was
in receipt of income support;
(b) was
entitled to a special component under Article 5(3)(a) of the Law or
resided in the same dwelling as another household that was entitled to a
special component under Article 5(3)(a) of the Law; and
(c) occupied
a dwelling other than a hostel or lodgings.[3]
(3) The amount of a special
payment under this Regulation shall be calculated according to the
formula –

where –
C is calculated according to paragraph (4); and
T is the aggregate, up to a maximum of 540, of the amount by which
the average daily temperature of each day in that month falls below 15.5
degrees Celsius.[4]
(4) C is –
(a) for
each cold weather month from October 2024 to April 2025 inclusive,
£193.37 increased or decreased by the same percentage as that of the rise
or fall in the fuel element of the Jersey Retail Prices Index published by
Statistics Jersey (within the meaning of Article 2 of the Statistics and Census (Jersey) Law 2018) for the 12 months
ending on 30th June 2024;
(b) for
each subsequent cold weather month, the figure produced by increasing or
decreasing the figure for the previous April by the same percentage as that of
the rise or fall in the fuel element of the Jersey Retail Prices Index
published by Statistics Jersey (within the meaning assigned by Article 2
of the Statistics and Census
(Jersey) Law 2018) for the 12 months ending in the previous June.[5]
(5) If a dwelling is
occupied by 2 or more households entitled to a special payment under this
Regulation –
(a) only
one special payment is payable in respect of the dwelling; and
(b) the
special payment is divided equally between all the households entitled to it.
(6) In this Regulation a
month is a “cold weather month” if the aggregate of the amount by
which the average daily temperature of each day in that month falls below 15.5
degrees Celsius exceeds 90.
(7) The product of each
formula in this Regulation shall be rounded up to the next whole penny.[6]

2B Modification
of Regulation 2 for purposes of special payments for months of October 2023 to
April 2024[8]
(1) This
Regulation applies instead of Regulation 2 for the purposes of any special
payment for the months of October 2023 to April 2024.[9]
(2) A
special payment may be made to defray the expenses of heating a dwelling for a
month from October to March inclusive to a household occupying the dwelling if
a member of the household throughout the month –
(a) was
under the age of 3 years;
(b) was
over the age of 65 years;
(c) met
the criteria for the personal care element of the impairment component under
paragraph 6(1)(c) of Schedule 1 to the Income Support (Jersey) Regulations 2007;
(d) was a
child who met the criteria in Regulation 3(a) of the Income Support (Special Payments) (Child Personal Care) (Jersey)
Regulations 2014; or
(e) was
awarded long term incapacity allowance for total incapacitation assessed at a
degree of 100%.[10]
(3) However,
a special payment may be made only if throughout the month the
household –
(a) was
in receipt of income support;
(b) was
entitled to a special component under Article 5(3)(a) of the Law or
resided in the same dwelling as another household that was entitled to a
special component under Article 5(3)(a) of the Law; and
(c) occupied
a dwelling other than a hostel or lodgings.
(4) A
special payment is £70.
(5) If
a dwelling is occupied by 2 or more households entitled to a special
payment –
(a) only
one special payment is payable in respect of the dwelling; and
(b) the
special payment is divided equally between all the households entitled to it.
(5A) A
special payment is not payable for the months of October, November and
December 2023 if a household was entitled to the special payment only
because a member of the household satisfied paragraph (2)(e).[11]
(6) This
Regulation expires at the end of September 2024.[12]

These Regulations may be cited as the Income Support (Special
Payments) (Cold Weather Payments) (Jersey) Regulations 2008.
