BUSINESS NAMES (JERSEY) ORDER 1998

THE FINANCE AND ECONOMICS COMMITTEE, in
pursuance of Article 17 of the Registration of Business Names (Jersey) Law 1956, as amended
(hereinafter referred to as “the Law”), and after consultation with the Jersey
Financial Services Commission, has made the following Order –
Forms
1. The statements and notices required
to be furnished under the Law shall be furnished in accordance with whichever
of the Forms 1 to 4 in the Schedule to this Order is appropriate, with such
variations as the circumstances in each case require.
Notice of registrar’s decision
2.-(1) If the registrar decides under paragraph (1)
of Article 15 of the Law to refuse to register a business name or to remove a
business name from the register, the registrar shall send by post to the
individual, firm or body corporate that applied for registration or was
registered under the business name notice in writing of the decision and of the
grounds on which the decision was made.
(2) The notice shall
include a statement that an appeal may be made to the Court against the refusal
or removal and the statement shall specify the time within which the appeal
must be made.
Savings and transitional provision
3. Any statement, particulars, notice
or affidavit received, or any notice issued or requirement made, by the
Judicial Greffier under the Law before the commencement of the amendments to
the Law contained in the Second Schedule to the Financial Services Commission
(Jersey) Law 1998 shall, on such commencement,
have effect as if received, issued or made by the registrar under the Law on
the date when it was in fact received, issued or made.
Citation and commencement
4. This Order may be cited as the
Business Names (Jersey) Order 1998 and shall
come into force forthwith.
