ROAD TRAFFIC (No. 6) (JERSEY) REGULATIONS, 1972.

THE STATES, in pursuance of the powers conferred on them by the Order in Council of the twenty-sixth day of December, 18511 and by Article 49 of the Road Traffic (Jersey) Law, 1956, as amended,2 (hereinafter referred to as “the principal Law”), have made the following Regulations:  -

1.             In paragraph (1) of Article 13A of the principal Law3 after sub-paragraph (a) there shall be inserted the following sub-paragraph –

“(aa)   a motor vehicle of any class or description at a speed exceeding thirty miles an hour –

(i)         on a road specified in an Order as a road to which this sub-paragraph applies;

(ii)        on a road within an area so specified as an area within which all the roads are roads to which this sub-paragraph applies;”

2.-(1)  After paragraph (2) of Article 39 of the principal Law4 there shall be inserted the following proviso –

“Provided that this paragraph shall not apply to the extent that the provisions of the Order with which the motor vehicle or trailer does not comply have been excluded or modified in their application to that vehicle or trailer, by virtue of a licence granted under paragraph (1) of Article 39A of this Law, and the restrictions or conditions specified in the licence in respect of such exclusion or modification have been complied with.”

(2)     After Article 39 of the principal Law5 there shall be inserted the following Article –

“ARTICLE 39A

AUTHORIZATION OF USE ON ROADS OF VEHICLES NOT COMPLYING WITH ORDERS UNDER ARTICLE 39

(1)          Where it appears to be desirable in the public interest so to do, the Committee may grant in respect of any motor vehicle or trailer a licence providing that, subject to such restrictions and conditions as may be specified in the licence, such provisions of any Order made under Article 39 of this Law as may be so specified shall not apply to that vehicle or trailer or shall apply subject to such modifications as may be so specified.

(2)          Application for a licence shall be made in such manner as the Committee may determine and shall be accompanied by such fee as may be prescribed.”

3.             These Regulations may be cited as the Road Traffic (No. 6) (Jersey) Regulations, 1972 and shall come into force forthwith upon promulgation.
