ROAD TRAFFIC (No. 10) (JERSEY) REGULATIONS, 1975.

THE STATES, in pursuance of the powers
conferred on them by the Order in Council of the twenty-sixth day of December,
1851, and by Article 49 of the Road Traffic (Jersey) Law,
1956, as amended, have made the following
Regulations: -
1. In
paragraph (1) of Article 2 of the Road Traffic (Jersey) Law, 1956, as amended, (hereinafter referred to as “the principal
Law”) –
(a) in the definition of
“heavy motor car” for the words “two tons and a half”
there shall be substituted the words “three tons”;
(b) in the definition of
“heavy motor cycle” after the words “light motor cycle
“there shall be inserted a comma and the word “moped”;
(c) in the definition of
“light motor cycle” –
(i) after
the words “not being” there shall be inserted the words “a
moped or”;
(ii) after
the words “two hundred” there shall be inserted the words
“and fifty”;
(d) after that definition
there shall be inserted the following definition –
“ ‘moped’ means a motor cycle, the cylinder
capacity of the engine of which does not exceed fifty cubic centimetres and
which is equipped with pedals by means of which it is capable of being
propelled;”;
(e) in the definition of
“motor car” –
(i) for
the words “heavy motor cycle, light motor cycle” there shall be
substituted the words “motor cycle, moped”;
(ii) for
the words “two tons and a half” there shall be substituted the
words “three tons”.
2. After
Article 3 of the principal Law there
shall be inserted the following Article –
“ARTICLE
3A
RECORDS OF LICENCES AND ENDORSEMENTS
(1) Every
licensing authority shall establish and keep a record of all licences granted
and renewed by him and a record of all endorsements from time to time duly made
on such licences.
(2) Every
licensing authority shall send to the Chief Officer of the States of Jersey
Police Force a copy of each completed form of application for the grant or
renewal of a licence and the Chief Officer shall also keep a record of any
endorsements made as aforesaid.”
3. For
paragraph (1) of Article 13 of the principal Law there
shall be substituted the following paragraph –
“(1) A
person shall not drive, and shall, for the purposes of this Law be deemed to be
disqualified for holding or obtaining a licence to drive, on a road a motor
vehicle specified in the first column of the following Table if he is under the
age specified in relation thereto in the second column of that Table –

4. Notwithstanding
Regulations 1 and 3 of these Regulations, a person shall not be prohibited from
driving a motor vehicle of any class or description if at any time before the
coming into force of these Regulations he has held, or was entitled (on making
the requisite application and declaration and on payment of the appropriate
fee) to the grant of, a licence, other than a provisional licence, authorising
him to drive that class or description of motor vehicle.
5. These
Regulations may be cited as the Road Traffic (No. 10) (Jersey) Regulations,
1975 and shall come into force on the first day of January, 1976.
