THE
DEFENCE COMMITTEE, in pursuance of Articles 33 and 42 of the Road Traffic
(Jersey) Law 1956, as amended, and after
consultation with the Connétable of Saint Brelade (hereinafter referred
to as “the Connétable”), hereby orders as follows –
PART I
INTRODUCTORY
Application
1. This
Order applies to roads in the Parish of Saint Brelade.
Interpretation
2.-(1) In this
Order, unless the context otherwise requires –
“parking disc” means a
parking disc of the kind described in Article 10 of the Road Traffic (Saint Helier)
(Jersey) Order 1988;
“road” includes part of a
road.
(2) In
this Order, unless the context otherwise requires, a reference to a numbered
Article or Schedule is a reference to the like-numbered Article of, or Schedule
to, this Order.
(3) References
in this Order to an enactment shall be construed as references to that
enactment as amended by or under any other enactment.
PART II
TRAFFIC CIRCULATION
One-way
traffic
3. A
vehicle being driven on a road specified in the first column of the First
Schedule shall, between the point of its entry therein and its departure
therefrom, follow the direction prescribed in relation to that road in the
second column of that Schedule.
Prohibition of waiting
4.-(1) A
vehicle shall not wait on any road specified in the Second Schedule.
(2) A
vehicle shall not wait on a road within ten yards of its junction with another
road.
(3) A
vehicle, other than a public service vehicle of the appropriate class, shall
not stop on any part of a road which is authorized under Article 47 of the
Motor Traffic (Jersey) Law 1935 (hereinafter referred to as “the Motor Traffic
Law”) as a stand for public service vehicles.
(4) A
vehicle, other than a vehicle delivering or collecting goods or merchandise,
shall not wait between the hours of 2.00 a.m. and 6.00 p.m. on a day other than
Sunday on a part of a road which has been set aside for the purpose of allowing
vehicles to load or unload goods or merchandise.
Public service vehicles
5.-(1) Except
with the permission in writing of the Connétable, or on the express
direction of a police officer, no char-à-banc shall be driven on a road
specified in the Third Schedule.
(2) Except
with the permission in writing of the Connétable, no char-à-banc
shall be stationed on any road.
(3) Except
on the express direction of a police officer no cab shall be stationed on any
road:
Provided that this paragraph shall
not apply to the stationing of a cab licensed under the Public Rank Taxis
(Jersey) Regulations 1956 on a rank as defined in those Regulations.
(4) In
this Article, “cab” and “char-à-banc” have the
same respective meanings as under the Motor Traffic Law.
Prohibition or restriction of turns
6.-(1) A
vehicle shall not be driven so as to make a right-hand turn from a road
specified in the first column of Part I of the Fourth Schedule into a road
specified opposite that road in the second column of that Part.
(2) A
vehicle shall not be driven so as to make a left-hand turn from a road
specified in the first column of Part II of the Fourth Schedule into a road
specified opposite that road in the second column of that Part.
(3) A
vehicle shall not be driven so as to enter Les Quennevais Parade from the
northernmost exit of Les Quennevais Park.
PART III
PARKING DISCS
Interpretation
7. In
this Part –
“parking” means leaving a
vehicle, whether attended or unattended, between the hours of 8.00 a.m. and
5.30 p.m. on any day other than a Sunday, and includes stopping a vehicle to
load or unload goods or merchandise, but does not include stopping a vehicle to
set down or pick up passengers;
“vehicle” excludes a
vehicle the overall width of which exceeds 6 feet 6 inches and a bicycle not
propelled by mechanical power.
Parking of vehicles displaying parking discs
8.-(1) Subject
to the provisions of this Article, a vehicle which displays a parking disc in
accordance with this Part may be parked on a road specified in the Fifth
Schedule for a period of time not exceeding one hour.
(2) A
vehicle shall not be parked on a road specified in the Fifth Schedule for a
period of time exceeding one hour.
(3) A
vehicle which has been parked on a road specified in the Fifth Schedule shall
not be moved directly to another part of the same road and parked there.
Indication of time on, and display of, parking discs
9.-(1) When a
vehicle is parked on a road specified in the Fifth Schedule, a parking disc,
indicating the time at which the vehicle arrived there, shall be displayed
against the internal face of the windscreen of the vehicle, or, if the vehicle
has no windscreen, at a convenient place on the left or near side of the
vehicle, in such a manner that the arrival time of the vehicle may be
distinctly seen by any person outside the vehicle.
(2) When
a vehicle is parked on a road specified in the Fifth Schedule, no person shall
–
(a) display
more than one parking disc on the vehicle;
(b) indicate
on the parking disc a time different from that at which the vehicle was parked;
(c) alter
the time of arrival indicated on a parking disc whilst the vehicle is parked on
that road.
PART IV
LOADING AND
UNLOADING OF VEHICLES
Parking of
vehicles for loading and unloading
10.-(1) Subject
to the conditions prescribed in paragraph (2) of this Article, a vehicle may be
parked on a road specified in the Sixth Schedule, for the purpose of being
loaded or unloaded in connexion with a trade or business carried on in the
vicinity.
(2) The
conditions referred to in paragraph (1) of this Article are that there shall be
displayed on the internal face of the windscreen of the vehicle or, if the vehicle
has no windscreen, at a convenient place on the left or near side of the
vehicle, and in such manner as to be distinctly seen by any person outside the
vehicle –
(a) a
parking disc indicating the time at which the vehicle was parked;
(b) the
business name and address of the user of the vehicle.
(3) No
person shall, in respect of a vehicle to which this Article applies –
(a) display
more than one parking disc;
(b) indicate
on the parking disc a time different from that at which the vehicle was parked;
(c) alter
the time of arrival indicated on the parking disc while the vehicle is parked
on that road;
(d) park
the vehicle for longer than one hour between the hours of 10.00 a.m. and 6.00
p.m. on any day other than Sunday.
PART V
MISCELLANEOUS
Saving
11. Article
4 and Parts III and IV of this Order shall not apply –
(a) so
as to prevent a vehicle waiting on any road for so long as may be necessary to
enable the vehicle, if it cannot be used for such purpose without waiting on
that road, to be used in connexion with any building operation or demolition
work, the removal of any obstruction or potential obstruction to traffic, the
maintenance, improvement or reconstruction of that road, or the erection,
laying, placing, maintenance, testing, alteration, repair or removal of any
structure, works or apparatus in, on, under or over that road;
(b) to
any vehicle whilst it is being used for fire brigade, ambulance or police
purposes;
(c) to
any vehicle being used for the purpose of delivering or collecting postal packets
as defined in Article 1 of the Post Office (Jersey) Law 1969;
(d) so
as to prevent a public service vehicle waiting on a part of any road which is
authorized in accordance with Article 47 of the Motor Traffic Law as a stand for public
service vehicles;
(e) so
as to prevent a vehicle waiting on any road for so long as may be necessary to
enable the vehicle, if it cannot be used for such purpose without waiting on
that road, to be used in connexion with the collection of household refuse
from, or the clearing of cesspools at, premises situated on or adjacent to that
road;
(f) to
a vehicle waiting on any road while any gate or other barrier at the entrance
to premises to which the vehicle requires access or from which it has emerged
is being opened or closed, if it is not reasonably practicable for the vehicle
to wait otherwise than on that road while such gate or barrier is being opened
or closed;
(g) to
a vehicle waiting on any road on the express direction or with the specific
permission of a police officer.
Revocation
12. The
enactments listed in the Seventh Schedule are hereby revoked.
Citation and commencement
13. This
Order may be cited as the Road Traffic (Saint Brelade) (Jersey) Order 1990 and
shall come into force on the thirty-first day of January 1991.
