ROYAL COURT (AMENDMENT No. 4) RULES 1994

IN THE ROYAL COURT OF JERSEY

THE SUPERIOR NUMBER OF THE ROYAL COURT, in pursuance of Article 11 of the Royal Court (Jersey) Law 1948, as amended,1 and all other powers enabling it in this behalf, has made the following Rules –

1.             After Rule 14/1 of the Principal Rules 1992,2 there shall be inserted the following Rule –

 

“Form of indices

14/1A.-(1)  The indices in relation to the various Registers in the Public Registry may be kept on a computer by means of and in the form of the computer system known as “PRIDE” instead of in the historic book form.

(2)          Entries in the indices shall be made –

(a)     in relation to a married woman, both under her maiden name and under the name of her husband;

(b)     in relation to a guarantee in a contract, under the name of the guarantor;

(c)     in relation to a woman who abandons her right of dower both under her maiden name and under the name of the man from whom she derives her dower; and

(d)     in relation to the registration of a will of immovables, under the names of the testator and the devisees.”

2.             The enactments specified in the first column of the Schedule to these Rules shall be repealed to the extent specified in the second column of the said Schedule.

3.             These Rules may be cited as the Royal Court (Amendment No. 4) Rules 1994, and shall come into force forthwith.
