THE STATES, in pursuance of the powers
conferred on them by the Order in Council of the twenty-sixth day of December
1851 and Article 49 of the Road Traffic (Jersey) Law
1956, as amended (hereinafter referred to as
“the Law”), have made the following Regulations –
1. In
paragraph (1) of Article 1 of the Law for the
definition of “the Committee” there shall be substituted the
following definition –
“ ‘the Committee’ means the Defence Committee,
except that –
(a) references
to ‘the Committee’ in Articles 32A, 32C, 33, 33A, 33B and 34A of
this Law shall be construed as references to the Public Services Committee, and
the power to make orders under Articles 13A, 32B, 32C, 33, 33A, 33B and 34A of
this Law, and to prescribe the size, colour and type of traffic signs under
Article 35, shall be exercised by that Committee;
(b) references
to ‘the Committee’ in the definition of ‘order’ in
paragraph (1) of Article 1, and in Article 42, of this Law shall be construed
as references to the Defence Committee or the Public Services Committee, as the
case may be;”.
2. Any
Order in force immediately before the coming into force of these Regulations
and made by the Defence Committee in pursuance of a power which, by virtue of
these Regulations, will be exercisable by the Public Services Committee shall
continue in force as though it were an Order made by the Committee under the
Law as amended by these Regulations.
3. These
Regulations may be cited as the Road Traffic (No. 45) (Jersey) Regulations 1994
and shall come into force forthwith on promulgation.
