Traffic (Rue des Prés Trading Estate) (Amendment No. 2) (Jersey) Order 2020

THE MINISTER FOR INFRASTRUCTURE makes this Order under Articles 62,
63, 64 and 84 of the Road Traffic (Jersey) Law 1956[1] after consultation with the Connétables of St. Saviour,
St. Clement and Grouville –
1 Interpretation
In this Order “principal
Order” means the Road Traffic (Rue des Prés Trading
Estate) (Jersey) Order 2017[2].
2 Article 1 (interpretation) amended
In Article 1 of the
principal Order after the definition “valid parking card” there is
inserted –
“ “valid remote payment” means a payment in respect of a
vehicle parked or to be parked at a pay card parking place, such payment
being –
(a) made by means of the internet;
(b) accepted by or on behalf of the Minister;
and
(c) of the amount of the charge prescribed in
Article 8 for parking the vehicle for the period during which it is parked
or to be parked.”.
3 Article 7 (parking card to be displayed on vehicles left in
pay card parking place) substituted
For Article 7 of the
principal Order there is substituted –
“7 Periods when parking charge required
(1) If a vehicle is parked in a pay card
parking place between the hours of 8.00 a.m. and 5.00 p.m. on any day
except Sunday –
(a) a valid parking card must be displayed in
such a way that it can clearly be seen by a person outside the vehicle; or
(b) a valid remote payment must have been made.
(2) In the case of paragraph (1)(a), a
person must not alter the time of arrival indicated on the parking card.”.
4 Article 9 (payment of charges) substituted
For Article 9 there is
substituted –
“9 Purchase of parking cards
Parking cards must be purchased from a person for the time being
authorised by the Minister to sell parking cards.”.
5 Part 4A (evidence) inserted
After Part 4 there is
inserted –

Evidence
15A Evidence
(1) A digital photograph taken by a person
authorised by the Minister of a vehicle displaying a registration mark that is
parked at a pay card parking place is prima facie evidence that the vehicle
assigned that registration mark was parked at that paying parking place.
(2) The metadata associated with the digital
photograph is prima facie evidence of the time and day the photograph was
taken.
(3) A printed copy of the records, held by or
on behalf of the Minister, of valid remote payments made in respect of vehicles
is prima facie evidence of whether a valid remote payment was made in respect
of a vehicle.”.
6 Citation and commencement
This Order may be cited as the Road Traffic (Rue des Prés Trading Estate) (Amendment No. 2) (Jersey) Order 2020
and comes into force on the day after the day it is made.
