(Public Service Vehicles (Conditions of Fitness)) (Amendment No. 2) (Jersey) Order 2016

THE MINSTER FOR INFRASTRUCTURE, in pursuance of Articles 7 and 46
of the Motor Traffic (Jersey) Law 1935[1], orders as follows –
1 Interpretation
In this Order “principal Order” means the Motor
Traffic (Public Service Vehicles (Conditions of Fitness)) (Jersey) Order 2003[2].
2 Article 1
amended
In Article 1 of the principal Order, after the definition
“permanent top” there shall be inserted the following
definition –
“ ‘taxi’
means a cab that is used or intended to be used to provide a cab
service.”.
3 Article 17A
inserted
After Article 17 of the principal Order there shall be inserted
the following Article –
The maximum number of
passengers that may be carried in the vehicle in accordance with a licence
under Article 6 of the Law must be clearly marked on the exterior of the
nearside of the vehicle in words and figures each of which is at least 25 mm
in height as follows –
‘Licensed to Carry
[number written as a figure] Passengers’.”.

2A inserted
After Part 2 of the principal Order there shall be inserted the
following Part –

21 Application
of Part
This Part applies to taxis.
The maximum number of
passengers that may be carried in the taxi in accordance with a licence under Article 6
of the Law must be clearly marked on the exterior of the nearside of the
vehicle in words and figures each of which is at least 25 mm in height as
follows –
‘Licensed to Carry
[number written as a figure] Passengers’.
A ‘Taxi’ sign approved
by the Inspector, clearly visible both day and night when the taxi is available
for hire, must be fitted.
An operational calendar
controlled taximeter of a type approved by the Inspector must be fitted in a
position approved by the Inspector.
(1) The supports of all seats must be firmly
fixed in position.
(2) A child booster seat which complies with
European safety standard ECE R44/04 must be available.
If fitted, a swivel cushion
must –
(a) comply with the following –
(i) be capable of turning 360 degrees,
(ii) be at least 380 mm in diameter,
(iii) be capable of supporting 120 kg (or 19 stone),
and
(iv) have a seat cover which is removable, flame
retardant and machine washable; or
(b) be approved by the British Association of
Occupational Therapists.
If fitted, a caddie strap
must –
(a) comply with the following –
(i) have a handle grip of more than 100 mm
in length,
(ii) have a strap length of at least 150 mm
and be adjustable to a length of 350 mm, and
(iii) have a padded handle with a slip-resistant
surface; or
(b) be approved by the Research Institute for
Consumer Affairs (RICA).
If fitted, a handybar
must –
(a) comply with the following –
(i) have a handle grip of more than 100 mm
in length,
(ii) have a strap length of at least
150 mm and be adjustable to a length of 350 mm, and
(iii) have a padded handle with a slip-resistant
surface; or
(b) be approved by the Research Institute for
Consumer Affairs (RICA).
If fitted, door threshold
strips must –
(a) comply with DIN Standard 67510;
(b) be at least 25 mm wide; and
(c) be in a contrasting colour to the exterior
and interior paintwork of the vehicle.
If fitted with storage space
for a wheelchair or lightweight portable mobility scooter, the measurements of
the storage space must be at least 735 mm x 330 mm x 805 mm.
If fitted to meet the
requirements of Articles 26 to 30 inclusive, the vehicle emissions must
not be capable of exceeding –
(a) 125g/km CO2, where the vehicle is
licensed to carry 4 passengers or less; or
(b) 175g/km CO2, where the vehicle is
licensed to carry more than 4 passengers.
If fitted to meet the
requirements of Articles 26 to 30 inclusive, the airbag fitted in the
front passenger seat must be capable of being de-activated when the vehicle is
transporting a dog which is trained to assist a blind person or a person with
another disability.
(1) In this Article, ‘wheelchair accessible
vehicle’ means a taxi constructed or converted specifically so that it
can accommodate at least one person seated in his or her wheelchair when
travelling on the road.
(2) If fitted to carry a person whilst in a
wheelchair –
(a) there must be in respect of the vehicle an approval
of the vehicle in accordance with Directive 2007/46/EC (Framework
Directive) as a wheelchair accessible vehicle;
(b) its emissions must not be capable of
exceeding 175g/km;
(c) the airbag fitted in the front passenger
seat must be capable of being de-activated when the vehicle is transporting a
dog which is trained to assist a blind person or a person with another disability;
(d) the vehicle must be capable of carrying at
least four passengers when none of the passengers being carried is occupying a
wheelchair;
(e) the vehicle must provide a means of access
into the vehicle by a person occupying a wheelchair with or without the
driver’s assistance.
(3) In paragraph (2), ‘Directive 2007/46/EC
(Framework Directive)’ means Directive 2007/46/EC of the European
Parliament and of the Council of 5 September 2007 establishing a framework
for the approval of motor vehicles and of systems, components and separate
technical units intended for such vehicles (OJ L269, 9.10.2007, p.1).
5 Article 21
renumbered
Article 21 of the principle Order headed “Citation”
shall be renumbered as Article 34.
6 Citation
and commencement
This Order may be cited as
the Motor Traffic (Public Service Vehicles (Conditions of Fitness)) (Amendment
No. 2) (Jersey) Order 2016 and shall come into force 7 days
after the day it is made.
