Proceeds of Crime (Supervisory Bodies) (Transitional Provision) (Jersey) Order 2008

THE MINISTER FOR ECONOMIC DEVELOPMENT, in pursuance of Article 43(4) of the Proceeds of Crime (Supervisory Bodies) (Jersey) Law 2008[1], orders as follows –

1        Interpretation

In this Order –

“exempt specified Schedule 2 business” means business falling within any of items 4, 5 or 6 of the Schedule to the Law;

“Law” means the Proceeds of Crime (Supervisory Bodies) (Jersey) Law 2008[2].

2        Transitional provision for persons carrying on regulated business

Notwithstanding anything in the Law, a person carrying on a regulated business who also carries on an exempt specified Schedule 2 business shall not be taken to have contravened Article 10(1) of the Law by virtue of any action that is taken, or not taken, by that person in the course of carrying on that exempt specified Schedule 2 business at any time on or before 19th June 2009.

3        Citation and commencement

This Order may be cited as the Proceeds of Crime (Supervisory Bodies) (Transitional Provision) (Jersey) Order 2008 and shall come into force forthwith.
