
Road Traffic
(Public Parking Places – Charges) (Jersey) Order 2017
THE MINISTER
FOR INFRASTRUCTURE, in pursuance of Articles 59 and 84 of the Road Traffic (Jersey) Law 1956 and with the concurrence of the Minister for Treasury and Resources,
orders as follows –

1 Interpretation
(1) This Order is to be
read as one with the Road Traffic (Public Parking Places) (Jersey) Order 2006.
(2) In this
Order –
“electric vehicle” means a vehicle that is powered
solely by an electric motor and that emits no more than 50 grams of carbon
dioxide per kilometre;
“low emission vehicle” means any vehicle that emits no
more than 50 grams of carbon dioxide per kilometre;
“plug in hybrid electric vehicle” means a
vehicle –
(a) that
is powered by an electric motor and an internal combustion engine designed to
work together and separately;
(b) that
has an on-board battery that can be charged from the grid; and
(c) that
emits no more than 50 grams of carbon dioxide per kilometre; and
(d) in
which the combustion engine supports the electric motor when higher operating
power is required or when the battery’s state of charge is low.[1]
(3) In this Order –
(a)
(b)
(c) a
reference to an electric vehicle’s or a plug in hybrid electric
vehicle’s being first registered in Jersey is a reference to that
vehicle’s first registration in Jersey by an individual who does not hold
a trade licence issued under Article 8 of the Motor Vehicle Registration (Jersey) Law 1993.[2]
2 Charges
for parking units
(1) The charge for each
parking unit is 82.86 pence.[3]
(2) However, the charge for
each parking unit is 41.90 pence in the case of a vehicle in which there
is displayed a document approved by the Minister indicating that the vehicle is
a low emission vehicle.[4]
(3) However, the charge for
each parking unit is 41.90 pence in the case of a vehicle in which there
is displayed a document approved by the Minister indicating that the vehicle is
an electric vehicle or a plug in hybrid electric vehicle, except that where
such a vehicle is first registered in Jersey after 31st January 2018,
no charge shall be payable for parking in a public parking place during the
period of 12 months beginning immediately after the date the car is first
registered in Jersey.[5]
3 Charges
for season tickets
(1) The charge for a
monthly season ticket is £133.81 for a season ticket that authorizes the
vehicle to be parked in the following parking places –

(2) The charge for a
monthly season ticket is £66.90 where the ticket authorizes a vehicle to
be parked in the parking places specified in Parts 2 and 3 of
Schedule 3 to the Road Traffic (Public Parking Places) (Jersey)
Order 2006, other than STP1 and STP5.[7]
(3) However, the charge for
a monthly season ticket in the case of a vehicle in which there is displayed a
document approved by the Minister indicating that the vehicle is a low emission
vehicle is £66.90 in the case of a parking place mentioned in paragraph (1)
and £33.45 in the case of a parking place mentioned in paragraph (2).[8]
(4) However, in the case of
a vehicle in which there is displayed a document approved by the Minister
indicating that the vehicle is an electric vehicle or a plug in hybrid electric
vehicle, the charge for a monthly season ticket is –
(a) £66.90
in the case of a parking place mentioned in paragraph (1); and
(b) £33.45
in the case of a parking place mentioned in paragraph (2),
except that, where such a vehicle is first registered in Jersey
after 31st January 2018 and there is displayed in that vehicle a
document approved by the Minister stating that fact, no charge shall be payable
for parking in a parking place mentioned in paragraph (1) or (2)
during the period of 12 months beginning immediately after the date the
car is first registered in Jersey.[9]
4 Excess
charge
(1) The excess charge
is –
(a) £40
if payment of the charge is received at the address specified in paragraph (2)
not later than 4 p.m. of the third day after the day on which the excess
charge was incurred (excluding any Saturday, Sunday or public holiday); or
(b) £60
in any other case.
(2) For the purpose of
paragraph (1)(a) the address is –
(a) if
the excess charge notice was issued on behalf of a parochial authority, the
parish hall of the parochial authority;
(b) if
the excess notice was issued on behalf of the Minister for Education, the
Finance Department, Department for Education, PO Box 142, Highlands,
St. Saviour, JE4 8QJ;
(c) if
the excess notice was issued on behalf of the Minister for Economic
Development, Tourism, Sport and Culture, the Finance Department, Fort Regent,
St. Helier, JE2 4UX; or
(d) in
any other case, the Parking Control Office, Sand Street Car Park,
St. Helier, JE2 3QF.
