(Exemption for Campaign Advertising Material) (Jersey) Order 2026
1 Exemption
The general prohibition
in Article 2(1) of the Highways (Jersey)
Law 1956 does not apply in relation to campaign advertising material
relating to a public or parish election, or a referendum, if –
(a) the material is placed
above a highway only during the campaign period in relation to the election or
referendum; and
(b) the material and its
placement comply with the conditions specified in the Schedule.
2 Citation and
commencement
This Order may be cited as the Highways (Exemption for Campaign
Advertising Material) (Jersey) Order 2026 and comes into force 7 days
after it is made.

(Article 1(b))
Conditions
1 Interpretation
In this Schedule,
“traffic sign” has the same meaning as in the Road Traffic (Jersey)
Law 1956 (see Article 1(1) of that Law).
2 General condition
Campaign advertising
material must not be placed above a highway in a location or manner that –
(a) obstructs or prevents the
ordinary use of the highway; or
(b) might reasonably be
regarded as resulting in a risk to the safety of members of the public.
3 Location – measurements to
footpaths and carriageways
(1) Campaign
advertising material placed above a footpath must –
(a) be placed at least
7 feet above the level of the footpath; and
(b) if it is placed less than
18 feet above the level of the footpath, be placed at least 1 foot
(measured vertically) from the kerb.
(2) Campaign
advertising material placed above a carriageway must be placed at least
18 feet above the level of the carriageway.
4 Location – signs projected from
buildings
Campaign advertising
material that consists of a sign projected from a building, extending beyond
the boundary of a building with a highway, must be placed in compliance with Article 1(e) of the Highway Encroachments (Jersey) Regulations 1957.
5 Location – minimum distance from
junctions, crossings and traffic signals
Campaign advertising
material placed above a highway must be placed at least 10 metres, in any
direction, from any traffic sign indicating that vehicles travelling in that
direction must stop or give way (whether at a junction, a pedestrian crossing,
a traffic signal or otherwise).
6 Location – property entrances
Campaign advertising
material must not be placed above a highway in a location that obscures, or
reduces, visibility for the driver of a vehicle entering or leaving a property.
7 Location – specific prohibition for
Victoria Avenue
Campaign advertising
material must not be placed above the highway known as Victoria Avenue.
8 Location and manner – attachment to
traffic sign structures and street furniture
(1) Campaign
advertising material that is attached to the same structure as a traffic sign
must not obscure, or reduce visibility of, the traffic sign.
(2) Campaign
advertising material is attached to street furniture must not prevent access
to, or ordinary use of, that street furniture.
(3) In
this paragraph, “street furniture” includes the street furniture listed in sub-paragraph (c)
of the definition “road asset” in Article 1(1) of the Road Works and Events
(Jersey) Law 2016.
9 Material – design and content
(1) Campaign
advertising material must not be of a design, colour or format that might
reasonably cause the material to be mistaken for a traffic sign.
(2) Campaign
advertising material, in the case of a printed document –
(a) must measure –
(i) at least 297 mm by
420 mm; but
(ii) not more than 450 mm
by 600 mm; and
(b) must not include text
with a height of less than 35 mm.
10 Material and manner of placement – withstanding
weather conditions
Campaign advertising
material placed above a highway must be sufficiently robust and secure to
withstand the weather conditions that might reasonably be expected in that
location.
11 Time and manner of placement
Campaign advertising
material placed above a highway must not be put up or taken down at a time, or
in a manner, that might reasonably be regarded as creating a risk to the safety
of members of the public (including the person putting the material up or
taking it down).
