Road Traffic (St. Peter) (Jersey) Order 1992

THE HOME AFFAIRS COMMITTEE, in pursuance of Articles 62 and 84 of the Road Traffic (Jersey) Law 1956 and after consultation with the Connétable of St. Peter, orders as follows –

PART 1

INTRODUCTORY

1        Application

This Order applies to the roads in the parish of St. Peter.

2        Interpretation

In this Order, unless the context otherwise requires –

“Connétable” means the Connétable of St. Peter;

“Motor Traffic Law” means the Motor Traffic (Jersey) Law 1935;

“road” includes part of a road.

PART 2

TRAFFIC CIRCULATION

3        One-way traffic[1]

(1)     A person who drives a vehicle on a road specified in the first column of Part 1 of Schedule 1 must drive in the direction specified in relation to that road in the second column of that Part.

(2)     Paragraph (1) is subject to the exemption specified in the third column of Part 1 of Schedule 1.

(3)     A person who drives a vehicle exceeding a width of 6 feet 6 inches on a road specified in the first column of Part 2 of Schedule 1 must drive in the direction specified in relation to that road in the second column of that Part.

4        Prohibition of waiting and stopping

(1)     A vehicle must not wait on any road specified in the first and second columns of Schedule 2.[2]

(2)     Subject to Article 7 and Schedule 5, a vehicle must not wait on a road within 10 yards of its junction with another road.[3]

(2A)   A vehicle must not wait on a road specified in the first column of Schedule 2A for a continuous period in excess of any continuous period specified in relation to that road in the second column of that Schedule.[4]

(2B)   A vehicle must not wait on a road specified in the first column of Schedule 2A for periods totalling more than any total specified in relation to that road in the second column of that Schedule.[5]

(3)     A vehicle, other than a public service vehicle of the appropriate class, must not stop on any part of a road which is authorized under Article 37 of the Motor Traffic Law as a stand for public service vehicles.[6]

(4)     A vehicle must not wait on a part of a road that has been designated as a no waiting area to allow access to premises from that part of that road.[7]

(5)     “Wait” in this Article does not include to stop a vehicle to set down or to pick up passengers.[8]

4A     Parking limited to vehicles loading and unloading[9]

(1)     Unless all the conditions in paragraph (2) are met, a person must not park a vehicle –

(a)     on a road specified in columns 1 and 2 of the table in Schedule 2B; and

(b)     at a time falling within a period specified in column 3 of that table.[10]

(2)     The conditions are that –

(a)     the vehicle is being loaded or unloaded in connection with a trade or business carried on in the vicinity;

(b)     the vehicle is parked for no longer than 20 minutes at any one time;

(c)     the vehicle is not parked in any part of that road within one hour of its departure from that road;

(d)     there is displayed on the internal face of the windscreen of the vehicle or, if the vehicle has no windscreen, at a convenient place on the left or near side of the vehicle, and in such manner as to be distinctly seen by any person outside the vehicle –

(i)      a parking disc indicating the time at which the vehicle was parked, and

(ii)      the business name and address of the user of the vehicle.[11]

(3)     The condition in paragraph (2)(d)(i) is not met if –

(a)     more than one parking disc is displayed;

(b)     more than one time is indicated; or

(c)     the time indicated is altered while the vehicle remains parked.

(4)     In this Article, “parking disc” means a disc issued by any Connétable that is composed of 2 pieces of pale yellow cardboard that enclose 3 red cardboard discs each pivoted about its centre on which are printed figures that can be revealed through 3 apertures cut into one of the pieces of yellow cardboard with the left hand aperture being capable of indicating an hour, the centre one tens of minutes, and the right hand one a minute.[12]

5        Closing of roads to through traffic[13]

A person must not drive a vehicle on a road specified in the first and second columns of Schedule 3, except to or from any land or premises having a means of vehicular access from that road.

5A     Roads closed to vehicles exceeding width of 6 feet 6 inches[14]

A person must not drive a vehicle exceeding a width of 6 feet 6 inches on a road specified in Schedule 3A.

6        Driving and stationing of certain public service vehicles

(1)     Except with the permission in writing of the Connétable or on the express direction of a police officer, a person must not drive a char-à-banc on a road specified in the first and second columns of Part 1 of Schedule 4.[15]

(2)     Except with the permission in writing of the Connétable or on the express direction of a police officer, a person who drives a char-à-banc on a road specified in the first column of Part 2 of Schedule 4 must drive in the direction specified in relation to that road in the second column of that Part.[16]

(3)     Except with the permission in writing of the Connétable, a person must not station a char-à-banc on any road.[17]

(4)     A person must not station a cab on any road except on the express direction of a police officer.[18]

(4A)   Paragraph (4) does not apply to a taxi-cab stationed on a taxi rank (as defined in the Motor Traffic (Cabs – General) (Jersey) Order 2021).[19]

(5)     In this Article “cab” and “char-à-banc” have the same respective meanings as under the Motor Traffic Law.

7        Restriction on parking

(1)     A person must not park a vehicle on a road specified in the first column of Part 1 of Schedule 5 for a longer period than that specified in relation to that road in the second column.[20]

(2)     A person must not park a vehicle on a road specified in the first column of Part 2 of Schedule 5 in a manner other than that specified in relation to that road in the second column.[21]

(3)     In this Article “parking” means leaving a vehicle, whether attended or unattended, and includes stopping a vehicle to load or unload goods or merchandise but does not include stopping a vehicle to set down or pick up passengers.

PART 3

MISCELLANEOUS

8        Savings[22]

(1)     Articles 4, 5, 5A and 7 do not apply to any vehicle while it is being used for fire brigade, ambulance, police or other emergency purposes.[23]

(2)     Articles 4 and 7 do not apply –

(a)     so as to prevent a public service vehicle waiting on a part of any road which is authorized in accordance with Article 37 of the Motor Traffic Law as a stand for public service vehicles;

(b)     to a vehicle waiting on any road while any gate or other barrier at the entrance to premises to which the vehicle requires access or from which it has emerged is being opened or closed, if it is not reasonable for the vehicle to wait otherwise than on that road while such gate or barrier is being opened or closed;

(c)     to a vehicle waiting on any road on the express direction or with the specific permission of a police officer;

(d)     to a vehicle stopping on any road owing to the driver being prevented from proceeding by circumstances beyond the driver’s control or to a vehicle stopping in order to avoid an accident.[24]

(3)     Article 7 does not limit the power of a police officer to require the removal of a vehicle which is parked in such manner as to be likely to obstruct the free flow of traffic.[25]

9        Citation

This Order may be cited as the Road Traffic (St. Peter) (Jersey) Order 1992.
